The Agent felt the project meets the performance standards and to get the machine back and forth would have a minor impact but suggested Matt communicate with the tribe. Matt said he will communicate with the tribe. There is no activity that will have any effect on the resource areas. The Agent said if he is willing to notify the tribe his opinion is to negate the notice of intent. He is just trying to keep things as calm as possible. Following a lengthy discussion, the Agent said if he is willing to notify the abutters and the tribe at least he would be doing due diligence. They can come back and object but he feels he meets the performance standards. Matt said he is willing to notify the tribe and the abutters. Motion: Mr. Gurnee moved to approve the administrative request for Gooseberry Island Trust to conduct test holes and that the applicant must inform the abutters and the tribe of such activity before any work commences. Seconded by Mr. McKay. Vote 3-2 with Mr. Shaw and Mr. Anderson voting in the negative. Mr, Anderson urged the applicant to work with all parties to try to resolve any disagreement. RDA Resource Area. a Aris Pappas was present representing the homeowner and explained he placed sand by a wheel barrel in an area that had poison ivy and weeds growing and the work was above the high water mark and did not impede on the salt marsh. He reviewed the drawing with the commissioners. The Agent said the previous existing condition is an unmaintained lawn. He recommended pulling the sand back five feet to keep the sand off the salt marsh. He said it is not affecting the resource area but is why he recommended pulling it back five feet to keep it out of the salt marsh. The area is relatively flat. The Agent noted this was a one time application and if Mr. Pappas plans on putting in more sand down he would have to come back before the commissioners. The other request is for removal of invasive species but Mr. Pappas was not
