i ! <br /> 4 <br /> Planning Board Minutes <br /> Meeting of August 1 , 1984 <br /> Ma bpee Town Hall <br /> The following members of the Planning Board were present for <br /> t ori i h t*' meeting: Richard Detbin, Chairman; Earle Mar ter , <br /> Harold Collins, Richardson Jonas and Michelle gone . Also <br /> present during the meeting was Town Engineer , Char-les Rowley. <br /> Chairman Dubin convened the meeting at 8:10 p.m. <br /> Hearing of Zonin Article Section 5.5 <br /> Chairman Dubi n asked if anyone wished t o speak can article 5.5 <br /> explai-ning that there was a problem with the advertising. <br /> Mr . Lau to asked for clarification , ba i rman Dubin said that <br /> the Board has not had an opinion from Town Counsel as to <br /> what the deletion of section 5.5 would mean, He said that <br /> the Board has questions in their own minds as to whether i <br /> would mean any lot which was grandfathered in by the 1977 act <br /> is now conforming, He said it may mean that all of those <br /> lots would become u n bu i t dab l e and owners would have to go to <br /> the Board of Appeals f r a variance or it may mean (as the <br /> Board of Selectmen intended) that it only apply to developers <br /> or builders who own contiguous lots. He said that in his <br /> opinion if you delete section 5.5 entirely it would require <br /> even non-contiguous lots to require a variance . Earle <br /> Marsters. commented that the Board of Selectmen sent the <br /> Planning Board a memo stating that they were unanimously in <br /> favor , but that the Board could not say why the Selectmen <br /> wanted the article passed. He said that they would ask the <br /> Selectmen to re-stipulate why they want it passed when they <br /> ask that i-t be raadver t i ed. He said that if anyone has an <br /> .ideas on how to amend it the Board would be interested, <br /> Earle Masters .moved to adjourn the hearing as there was a <br /> fault in the advertising. He said that it would be <br /> rescheduled and read er t i sed and that the Selectmen would be <br /> notified. Richardson Jona seconded the motion, All were in <br /> favor. <br /> Harold Collins asked if anyone could get perm i- s. Chairman <br /> Dubin sa-id that the Board voted to adjourn and re-advertised <br /> therefore rescinding the legality of it . Ear-le Marter <br /> commented that the Department of Community Affairs was not <br /> notified and that was the fault with the advertising. <br /> Dori Bl s emen asked if the article should come before annual <br /> town meeting rather than a special town meeting as special <br /> town meetings are for emergencies items, Earle Mar t e r <br /> cwnen ted that they have often used other meetings and that <br /> they are better off with a separate meeting. Harold Collins. <br /> said that he thought it would be considered an emergency. He <br /> said that it would never get approved at town meeting as i <br /> takes two-thirds of the town vote .
