Box 1108 <br /> Mashpee, MA 02649 <br /> Gentlemen: <br /> Ike Subdivision Plan of <br /> ckway Bay Realty Trust and Cartal Development Corp. <br /> ' in Mashpee, Massachusetts ` <br /> Our Job No. 84,550 and 84,411 <br /> .Please consider this letter as a request for a waiver of ,Section <br /> 'til, Paragraph E-3 as .it pertains to width and allow a.narrower pavement' . <br /> of only sixteen feet.width in the referenced subdivision. The lannirig. ' <br /> Board may waive its reguldtlions where such action is in the public. ;interest <br /> and not inconsistent with the intent and purpose of the Subdivision. Cbntrol <br /> .a <br /> Law, <br /> ` We believe that the waiver is in the public interest for the reasons' <br />` outlined below. <br /> The proposed subditrision is the creation of ten lots from a total <br /> + acreage of 26.7t acres. The Proposed road, because of frontage re- <br /> quirements, could not serve any additional 'lots. The low number of fto- <br /> posed <br /> houses is directly the result of the proposed design. It would- <br /> be possible' to create more homesites by extending the road to the south <br /> parallel to ockway Bay. The developers -have, therefore, created a design <br /> that will benefit the town since fewer lots ars eing proposed. The town <br /> . ought to encourage' low density development'ti-and' in the. recent.-g st-' . <br /> done' . so in the caae .of the nearby subdivision -plan for Punkhom Point Realty <br /> Trusty* <br /> ,fit believe that -tM waiver meets the intent 0`,f the Subdivision Confr6l <br /> Law, is for the provision of adequate access to all of the lots in a su6- <br /> i isi n by ways that will be wife and convenient f dr travel; ,.•. .., for. <br /> reducing; danger to life and limb in the operaation of.`motor vehicles; (and), <br /> for s0curing safety in -the case of`fire, flood and other emergp' qcie- <br /> .it is',cur opinion that the narrower pavement is consistent witti•,the above <br /> pux-poes. The-narrower- pavement is. conducive to slower vehicular.."speeds <br /> r and sl.a.wer vehicular speeds are'=safer.
