3 <br /> Community Preservation Committee <br /> Minutes <br /> ,January 23, 2007 <br /> NEW BURNESS: <br /> Deliberations: (continued) <br /> 1n response to the memorandum received from Town Counsel, Ms. <br /> Goldberg indicated the Ton has existing legal access over Hollow Road, <br /> Josephine's Bend and Chopchague Road as per the 1999"Bicl erstaffe" <br /> land acquisition; certificate of title##154181. It was also noted there <br /> would be precedent for the Town purchasing the land for conservation <br /> subject to private individuals retaining access rights over such land; <br /> referenced was the"Lopez"'property 1 +acres), deed book 1 093 l/page <br /> 9. <br /> Ills. Goldberg also explained there would be a strong likelihood of Mate <br /> reimbursement Self Help grant funding for 50% of the acquisition costs. <br /> Discussion followed relative the opinion received from Town Counsel <br /> regarding the existence of such rights for access and potential utility <br /> purposes that could reduce the value of these parcels to the Town or limit <br /> their usefulness if the goal is to acquire the property for open <br /> space/preservation purposes, and of the.potential to raise legal disputes. <br /> The Self-Help grant and related finding procedure was discussed. There <br /> is a State reimbursement grant program which also provides funding to <br /> protect current and future drinking water supplies by preserving lands <br /> within a Zone II area ofcontribution. <br /> Ed Baker, Mashpee Environxnental Coalition President requested <br /> favorable support from the Committee for the purchase of the hills <br /> property. Mark Robinson, Executive Director of The Compact of Cape <br /> Cod Conservation Trusts, Inc. was in attendance also in support of the <br /> Mills lands. David Ttely, President ofthe Orenda Wildlife Turd Trust <br /> was also present and sent a previous letter of support. Torn Fudala, the <br /> Town Planner was in attendance to voice his support as well. <br /> Gerald Umina, Algonquin Investment Trusts indicated that he did not have <br /> a certified appraisal to date, Mr. Umina presented a list of Town <br /> assessments of area two-acre zoning. It was noted that four two acre lots <br /> looted in the subject area are presently each assessed over$200,000. Mr. <br /> Umina has an open space application before the Committee for an <br /> approximate 7 acre parcel. The requested sum is $700,000. <br /> a <br />
