4 <br /> Community Preservation Committee <br /> Minutes <br /> January 12, 2010 <br /> Discussion ofticles: <br /> aca Properties: (continued) <br /> As per his memorandum,, Mr. Tem requested the Town of Mashpee make <br /> its intentions known regarding its interest in conducting negotiations for <br /> the purchase of the subject property. Mr. Ferry indicated the cost is <br /> presently negotiable to meet a sensible and rationale price for the Town. <br /> Habitat for Hum —26 Russell Road: <br /> Correspondence was received from Habitat for Humanity of Cape Cod <br /> dated January 12,20 10 relative to their application for CPA funding for <br /> the purchase of land located at 26 Russell Road, The project application <br /> also includes CPA funding to assist in-the construction of the affordable <br /> home. <br /> At the last meeting there were questions regarding the property.with <br /> respect t square footage as it pertains zoning requirements and also <br /> regarding the Chapter 40B permitting process. The lot as It is Presently <br /> configured is non-conforming and the layout as presented to the CPC <br /> Committee has not been approved to date by the'Planni g Board. <br /> Under the provisions of Chapter 40B,the lot would not be designated as <br /> buildable without the approval of numerous variances. <br /> Donald Dickinson in his memorandum indicated he met with the owner of <br /> the subject parcel,John west and with Worn Fudala,,the Town Planner to <br /> address the Committee's concerns. <br /> As noted in the correspondence,the perndtti g process would require NIr. <br /> Nest to meet with the Planing Board to request an AIq (Approval Not <br /> Required)designation. Habitat would then seep a Comprehensive Pennit � <br /> under the conditions of Chapter 40B to allow the building of the <br /> affordable home on the newly created ATR parcel. The parcel which <br /> contains Mr. west's residence would remain in excess of 40,000 sq. ft., <br /> the area required by zoning to remain.buildable. <br /> The purchase and sale agreement between Habitat for Hui ani y.and John <br /> West is pending the CPA award and all permitting to allow the building of <br /> the affordable home at the Russell Road location. <br />
