Conservation Commission Manch. 4. 1993 Page 5. Mr. Homeyer �nsl.sted the piles 'at the end of the 6 x 2 -float be removed. Mr, Sherman agreed they could be jetted out. Mr. Desrosiers suggested permitting one float, up to 200 s.f. , designed anyway Mr. White would want. Mr. DiGregorio stated they are going to have to go for a 30 year license for the additional piles anyway as they don't qualify for amnesty so they right as well include the 10 x 20 float. He was sine that would be agreeable to Mr. White.. if the Commission would like to remove the other three floats that have been added illegally since the licensing procedure, but he felt strongly that the additional pilings they are askinfor is something that the Commission should consider. Mr. Sherman asked if he was asking to keep the 10 x 20 float; he was. if he is going to keep that float, since it is an illegal float, he will have to pay After- The-Fact filing fees. Vim: Notion made and seconded that an Enforcement order be issued that the two illegal floats be removed, a fine be issued to both parties, and After-The Fact filing fees be paid for pilings put in, as shown on the plan. Also, that the forward double piles be removed on the north end, that he provide • the name of the contractor who put in the piles and rye of the contractor who built the deck, that both parties be fined and after-the-fact fees be paid for the deck. Public comments were requested; there were none. VOTE Motion made and seconded that if he does not comply with the enforcement order by April 29, 1993, the date of the continued hearing, he will be fined $300. per day for violation of the Enforcement order. UM: Motion made and seconded that the filing for the deck be a separate issue and that -i t be sum.t t ed within 30 days, VOTE: Motion made and seconded to condition one float to x 20 and continue to a date certain to- receive the revised plan and narrative. M: Motion rade and seconded to continue to April 2 , 1993 at 7:10 p.m. Mr. Sherman asked if the timber wall is part of this filing? Hr. DiGre ori stated j it is not part of the filing but wild. have to be licensed. It did not get pernni•tting but does predate 1984; it is below Mean High Vater. Mr. Sherman stated they will need the rrui ssion to include it in an -Order of Conditions. Asked if-, filing fees were paid, they were not. Mr. DiGregorio stated they will include this with the deck filing. Mr. Johansen had figured the fees and it was ascertained, fees were paid for the timber retaining wall.
