Conservation Commission <br /> March 1 , 1993 <br /> Page 1 . <br /> The other issue was leaching of the railroad ties and having them tested. <br /> Mr. Sherman had asked if John Slavinsky would certify to the structural <br /> integrity of the ties. Mr. Cardillo asked why the landscaping walls have <br /> to be certified by an engineer? <br /> Mr. Desrosies stated it would be a domino effect if the tap wall fails. <br /> Anything over four feet in height has to be certified. <br /> Mr. Cardillo advised they are proposing to have cement walls; footings and <br /> eight inch walls. <br /> Mr. Sherman read from the instructions for a Notice of Intent re requirements., <br /> Mr. Cardillo asked to continue in order that their attorney can be present. <br /> Mr . Slavinsky stated one of the problems was that there wasn t t enough foresight <br /> in looking into exactly what it would cost to change the wall to something suitable <br /> to the commission and fighting about leaving the wall there. <br /> Mr. Sherman has spoken with Robert Cardillo and Town Counsel today and no one wants <br /> to go back into court again. He and 'down Counsel have agreed on how to proceed. <br /> Also, Mr.. Cardillo's is tens have not been picking up the mail. Mr. Sherman asked <br /> Mr. Cardillo to sign a paper that he i's accepting the letter returned to the Comi7 <br /> ission that was refused by his sisters. <br /> Mr. Cardillo stated he is down as agent for his sisters and did not see any point <br /> n signing this. Also, this was faxed to him and they do have a copy. <br /> Mr. Sherman read from the letter which was the Commissionts understanding at the <br /> previous hearing of what was needed: The revegetation done by lied Philie was <br /> going to have to be extended to show the entire slope and that plan rust include. <br /> remedies for the salvaging of the existing trees with root systems impacted by <br /> the filling. The plan must be dome by Mr. Philie or another qualified certified <br /> arborist ardor registered landscape architect. <br /> As specified in both the enforcement order and court order, plan must provide <br /> details of any proposed terracing, regrading, emplacement of engineered structures, <br /> thin would be for instance, the concrete wails. Said plan must bear the stamps of <br /> a professional engineer, registered land surveyor, and must include, unless in a <br /> supplementary stamped plan, details to the upgrade of a Title v septic system. <br /> Along with the plans described above, details of revegetation and construction <br /> methodologies, as well as time tables for both, must be provided. During this <br /> time frame, satisfactory erosion control must be maintained according to the <br /> recommendations of the Sail Conservation Service, previously provided. During <br /> this interim period, enhancements and refurbushing of the erosion control devices <br /> as deemed necessary by the Commission or its agent must be dome as required. <br /> After the storm of the weekend, more haybales are necessary. <br /> Mr. Sherman stated at the last meeting Mr. Cardillo had stated he was going to <br /> hire someone local to represent him; that has not been done yet. <br /> Details of the above must be acomp .ished in a timely fashion in order that <br /> revegetation may be accompla-shed in the optimal time this spring, that is before <br /> Tune 1, 199 <br /> .
