Steve Wilson presenting. They had an Order for the existing pier, as it was. An ENF was filed and one requirement is to stop the float from resting on the bottom. The only changes from the previously approved plan are 411' pipe piles with float stops. Mr. Sherman concurred this is a better solution. ! Mrs. Ferriday asked how they mould be adjusted and was told the dock person who puts theme in will do this. She suggested conditioning that they be done properly each year. It was noted the float and ramp are removed and stored each year. Public conments were requested; there were none. Motion made and seconded to amend the Order of Conditions and condition that the agent be advised of the adjustments that have to be rade every year for the placement of the float. Mr. Sherman advised this hearing is only because of the lack of abutter notification. It could not be ascertained that this notification had been received. VOTE: Motion rade and seconded that Mr. Mitchell readvertise and renotify abutters for this RDA.. Mr. Kaplan asked if Mr. Roberts represented Gladstone. He referred to a 22 page document concerning the association. Mr. Sherman stated Mr. Kaplan can raise any objection that he wants but the Commission's only concern is damage to the resource area. Mr. Kaplan asked why .the deck is being replaced? Atter. Henchy, present with Mr. Kaplan, asked who is going to do the work? Ms Lannik stated the Commission has an applicant requesting an RDA, the Commission cannot go too much beyond that.
