He stated that Mr. Cardillo is here <br /> and he thinks that the creosote walls that are gone and the walls that are still there, <br /> the landscaping, proposed landscaping plan that is bung submitted, Mr. Cardillo right <br /> be able to answer your questions, better than he could. <br /> Nis Lannik suggested starting with one thing at a time because the issues are confusing. <br /> Mr. Sherman stated he was prepared to make some statements as to where we stand. <br /> Ms Lannik thought that to be appropriate. <br /> Mr. Sherman stated we are holding a hearing tonight because we had received a number <br /> Brom DBP and thought this was the proper thing to do after receiving a number as, <br /> legally, we should hold a hearing. We have required a number of things on the original_ <br /> enforcement order, which he will get to, and these were also reflected in the recent <br /> court order issued by the Barnstable Superior Court. One of things that we requested. <br /> was, other than the septic issue that we talked about, was a report or a plan from a <br /> landscape architect or a certified arborist addressing revegetation with appropriate <br /> iridigenous species and was to include, and this was from the original enforcement order <br /> that was issued in November, information aba:t saving the significant trees threatened <br /> by having their root systems covered with fill. I have received this plan dome by Ned <br /> Philie. As far as it goes; he has some good choices for vegetation at the bottom of the <br /> i <br /> slope; it did not however address what we asked for in our enforcement order which was <br /> some recorjnendation regarding the trees whose roots were impacted by the fill., so that <br /> is lacking. We had also required in our enforcement order, and the court order did too, <br /> some information on revegetation on the whole slope, not just the portion below the <br /> first wall which is still. there. As you all remember, the first wall. was -at the edge <br /> of the water and was removed. So, the plan, as of the moment, does not give us every- <br /> thing we need. The recommendations by Mr. Phi-lie that I see there seem to be quite <br /> justifiable but, for the record, we still lack information about the existing trees <br /> and how to sage them. we also need some information about the remaining slope. I did <br /> tell. Bob, Mr. Cardillo, that the rest of this would not have to be so intensively veg- <br /> etated as the lower part, but we do have to have some information about what -he recommends. <br /> Mr. Cardillo stated he has his sisters here tonight who own the property. He intro- <br /> duced Robin and Carmella Cardillo, He is just. trying to get thein l,nvolved in this <br /> and show them what 1s going on. They are the ones that can furnish the pictures of <br /> the property and what was existing before all this happened; you haven t gotten any <br /> pictures yet. <br /> Mr. Sherman stated that would be helpful. <br /> Nor. Cardillo stated he told her that you needed them and she is going to Federal <br /> gess them tomorrow. we do intend, I know wIre not showing anything here and <br /> obviously we do not intend to leave it like this but you probably want to see some- <br /> thing to the fact that we're not going' to leave it like this,, grass, trees, shrubs. <br /> Mr. Sherman stated we can't r-nake that decision until we see what pre-existing <br /> conditions were, <br />
