<br /> Mr. Sherman stated that will have to be supplied after you provide documentation of

<br /> Mr. Cardillo stated even if there wasn't anything there before, they are still going
<br /> to add to i t. Mr. Sherman stated i t would be advisable to do so. I amJUst trying
<br /> to go through parts of the enforcement order to let us know where we stand. This
<br /> leaves us with another part of the enforcement order, also reflected in the court
<br /> order, which can't quite be done at this point and that is for a new plan to be
<br /> prepared by Cape & Islands Engineering reflecting stabilization for the dole slope.
<br /> In other words, incorporating CTed hilie's recommendations and whatever else you
<br /> think advisable being engineers, in terms of slope stabilization. Now, that right
<br /> involve replacement of those creosote walls; that port we still have to talk about,
<br /> but we don't have those two things, we just received this the other day.
<br /> Mr. Sherman continued', also, at that point., if we continue on and get that information,
<br /> we would need a timetable for the restoration. In ether words, this is an exposed
<br /> slope and can't be allowed to remain this way for the next three years. Whatever we coo
<br /> you want to get done this growing season.
<br /> Mr. Cardillostated once they get this notice they plan on hiring a contractor and
<br /> getting this thing done fast.
<br /> Mr. Sherman continued on to another couple of areas of the enforcement order and the
<br /> requ:Lrements of the Commission. As you know, I go out there .a couple of times a week,
<br /> there are some more haybales put i.n, I thank you for that. Eventually, when the
<br /> weather clears, we will meed -same more staking of hables and silt fence added to
<br /> that row right at the bottom but for the mornent it is satisfactory. If you have been
<br /> there lately, I don't know if you lnow that the dock got wiped out by the ice. Legally,
<br /> you cannot replace that dock without filing and you have problem with Chapter 91 which
<br /> is not an enforcement problem with us. I don't know if John has explained the Chapter
<br /> 91 issues to you. Mr. Cardillo stated he started to,
<br /> Mr. Sherman stated because it i's now out, if you were to replace it, you can't legally
<br /> do that, - So, if you want to have that dock replaced, you are going to have to incorp-
<br /> orate into this filing or submit a separate filing. That's not an enforcement issue
<br /> With us, it's just the law.
<br /> Mr. Cardillo stated that dock can be talo out at the end of the summer and put back.
<br /> Mir. Sherman stated he was telling ham, until such time as you get a Chapter 91 license,
<br /> you shouldn't put it out again next summer,, I noticed when I was theme the other day
<br /> too that there had been an irrigation system that was part of the landscaping around
<br /> there; there are some components of it, sprinkler heads. Mr. Cardillo stated that was
<br /> correct. Mr. Sherman stated that should not, unless that's abandoned, and that is their
<br /> decision, it would have to be shown on a filing. Mr. Cardillo stated it is abandoned, i
<br /> Mr. Sherman stated if they decide to abandon that, it should state so. Eventually,
<br /> they are going to have submit a revised Notice of Intent.
<br /> Mr. Sherman stated there are two other issues, one we already mentioned, the Board of
<br /> Health, we can't go ahead on the septic plan, we already mentioned that issue. I
<br /> should 'Hake a statement- about the 'testing for the creosote and bring that up to date,
<br /> Mr. Cardillo had suggested to me some time ago that he would like top rovide the Con .
