F41 7/fL <br /> MASMM k <br /> ' MON COM1IssIO <br /> Minutes of March 26, 1992 <br /> Commissioners Present: Harry Desrosiers, Gertrude sons, Renee Fudala, <br /> Kathleen Terrio. <br /> The meeting was called to order at 6:20 p.m. <br /> 6:15 TRITON REALTY [A for an Amended. Order of Conditions under SE 43-950 at <br /> 70 Triton Way. Mike McGrath gave the background. An appeal was filed; a settle- <br /> ment was reached. DEP has asked for certain items in the Order of Conditions for <br /> the appeal to be dropped. A survey is to be done every two gears, any erosion t <br /> be reported. If any sand is brought in, it will be to bring it to the level before <br /> the erosion existed. <br /> They performed two transects; they went out to negative 7 feet. Photos were <br /> provided. Erosion has continued since Hurricane Bob and because of this, they <br /> are asking for an addition 300 c.y. to restore the existing bank to the condition <br /> -.t was before the hurricane,, It may be 400 c.y. <br /> Mr. Sherman. stated the toe has moved in ten feet; top of the bank is roughly the <br /> sane. It is a thick wall 4 - 5 feet at the base up to 1 foot. If an Amended <br /> Order is issued, DEP will be asked to issue a withdrawal letter. There are n <br /> objections to what DEP has requested. It was noted a copy of a letter from DEP <br /> was in the file, <br /> The original order referenced cobble in front, that should, be deleted from the <br /> order. <br /> Mr. McGrath stated he did not show any dune, it is gone completely. <br /> Public comments were requested; here were none. <br /> VOTE: Motion made and seconded to close the Amended Order Hearing, <br /> Mr. Sherman will review the previous Order of Conditions and delete the reference <br /> to the dune. <br /> Atty. Carter thanked the Commssion for advancing them as quickly as possible. <br /> BEARING CLOSED., <br /> 6:40 LAWRENCE W. DQE to remove an exi s ting dwelling and reconstruct a three <br /> bedroom dwelling with septic system at 15 Dean's Hollow Road. <br /> it. Sherman advised this is a re-hearing due to abutter notification not being <br /> sufficient under the bylaw. He asked if any abutters would like to be heard. <br /> A description of the project was read. <br /> Mr. Sherman asked how much of the existing foundation will remain' He was told <br /> as much as possible. Mr. Doyle stated he would not know until they go out to <br /> bid. The footprint will remain the same. <br /> Mr. Harold Oloran, ars abutter, was concerned with what is being done. He asked <br /> if the house is going to be sold. Mr. Doyle stated it is. Asked if he would <br /> renovate prior to selling, Mr. Doyle did not know. Mr. Cloran asked if someone <br /> purchases the house, would they have to go along with Mr. Doyle's plan? Mr. Doyle <br /> stated they would. Mr. Sherman added, unless they file again. <br /> The plan was reviewed:" Board of Health approval has been received. Grades will. <br />
