Mr. Sherman suggested approving just the pilings and would like to see a plan of what is there. Mr. Hoeyer asked the size of the additional float and was told ' x 20' . Mr. Sherman advised there is a lot of activity on the side of the lot with pl�-- wood going down to the water. Mr. Wh .te stated those floats were under the emergency provisions for repair. Mr. Sherman would not want to see the plywood stay there. Mr. White advised it was used to launch the floats-and will not remain, Mr. Desrosiers asked the location where floats were stored' Mr. White advised they are normally left in* Mr. Sherman stated if the plywood is taken out, he would have no problem with the project. Mr. Desrosiers asked Mr. White if he would notify the Agent when floats are taken out's Mr. White agreed, Mr. sherrian stated the Commission would want to issue this negative determination with a condition that the second float is not authorized until such time as the amnesty is obtained. Mr. White agreed. This will have to be recorded. Public comments were requested; there were none. It was noted, if Mr. -White files for a 99 year amnesty, the commission does not give perpetual maintenance on an RDA, only a notice of Intent. Motion made and seconded to find a negative determination based on the fact that approval is not given for the extra float while awaiting Chapter 91 approval. A negative determination was received from the Conrdssion. Mrs. Neubert went forward for an interim amnesty permit. Rather than repair it, it was decided to replace the wall. It was decided to go for a 99 year license for the dock. It is a vertical concrete reinforced gall. Footings will be hand dug. only backhoe will be used on the two returns. The boat ramp will be resurfaced. There is an additional 9 s.f. as it catches a pocket of water. There is spartina; there is an ACEC ACEto Mean High Grater, There is a detail in the package for the layout of the siltation fences. Mr. Sherman stated a PF stamp will be required on this plan. Mr. Doyle agreed. He advised no part of, the wall, including the footing, goes below Mean High Water.
