Conservation Commission
June 18, 1992
Page 2.
Mr. Greelish directed Elias McQuaid and Orin Frans to determine the extent of
dumping and remediate at their discretion. This will move as quickly as possible.
Mr. Coffey asked if wetland vegetation would then be a second stage?
1r. Sherman stated it would have to be ascertained what was there before.
Mr, Greelish suggested samples be taken out of the kettle hole to determine how
bad the situation is.
Mr. McQuaid recommended sending a registered letter to Mr. Oakley that he appear
before the board next week; failure would result in a standard $300. fine for
dumping.
Mr. Doherty wants to see an action.plan.
The letter will go out tomorrow- Eli-as McQuaid to hand deliver.
00 , RONALD B; 1, 53 Sand Dollar Lane. Nor. &.Mrs. Bernarducci presenting.
The project was stated and abutter notification receipts were provided.
Mr. Sherman gave the background; 1t is an After-The-Fact filing. He had no pro] l em
with the fence. This was reviewed by the arborist and report was provided. With
replanting of bayberry and one other species, this can be done. Details of the
replanting will be reviewed by he and Mr. Bernarducci, to go over where the bay-
berm bushes will be planted. Turning of any further cutting can be conditioned.
He explained the manner in which perpetuity is granted.
Public comments were requested
Fred Luconi: This lot is clear cut. Every other -'lot- on.. t his street is full o
big trees, Before commenting n this request, he would like to know what happened
the first time around. He asked if everyone can do this?
Mrs. snns stated they are under the New Seabury special pont. The Architectural
Review Committee can strip lots if they want to. She agreed with hien that it is
appalling.
Mr. Sherman stated a person cannot do that WIthln 100 feet of the resources without
going through the proper procedures.
Mfr. Luconi asked 'if there was any thought given to bringing it hack to the way it
w ,s? The lot leaps out because it was clear cut. Everyone should be playing by
similar rules. He asked if pruning in perpetuity is generally available?
Mr., Sherman stated there would have to be an evaluation and a filing with the .
commission.
Mr. Luconi stated it is easier after they clear cut their land. The iss a-is that
this happened and if others started to make adjustments to their lots, we should
all be playing by the same rules.
Mr. Sherman offered to contact him tomorrow to go over things more fully.
Mr. Luconi`s concern is that everyong else that would like to do pruning in perpetuity
have the same opportunity.
