Conservation Commission <br /> February 21, 1 1 <br /> Page 1 . <br /> WnIM END: Atty, Pat Butler, outside council for Resolution Trust came before <br /> the commission. Title is held in the old Evergreen Holding. The enforcement order <br /> was reviewed with the person in charge and managing agent and he has received <br /> authorization to arrange a site visit. It is their recommendation that any steps <br /> necessary to address the concerns be taken In the process. <br /> Mr. Butler advised the capabilities of Resolution Trust to do things is substant- <br /> ially slowed down by various statutes relating to takeovers. They have kept the <br /> planning board abreast of the issues and they have a very serious concern with <br /> the perMit. They are aware of the information given to the commission tonight. <br /> In light of the enforcement order, they have requested a waiver. The problem <br /> with this property is that in the process of development there was the inability <br /> to sell units or individual.. There may be a decision at some point in time to <br /> hold onto the property and manage it. They may request time to extend. <br /> Mr. Sherman stated if RTC is going to sell, the Commission would have legal means <br /> to draw up a document that the new owners would have to follow. <br /> After discussion, it was agreed an on-site will be scheduled for the first part <br /> of April.
