She will view the site <br /> with the agent. <br /> Ms Bebrman abstained from discussion as an abutter, It was noted the <br /> Board of Health has concerns. Mr. Sherman advised there are no apparent wetland <br /> issues. The Commission will walk the site. <br /> SFABURY APM, Barnstable: Source for nature wetlands materials - brochure <br /> circulated. <br /> LOT 31 TUTOW CIERCL : Prehearing conference to be rescheduled. Estimate received <br /> from Don Schall of IEP for representation, $868 - $1000. <br /> Mrs. Simmons suggested the Executive Secretary be consulted. It is a pivotal case <br /> state-wide. The Conservation Law Foundation to be notified of the adjudicatory <br /> hearing. <br /> VOTE: Motion made and seconded to allocate funds to pay IEP and to seek <br /> supplemental help for the funding. Unanimous vote. <br /> MILTON GLASS: Letter from Mr. Mrs. Glass distributed. <br /> SCCA - south Cape Civic Assoc. : Proposed order of Conditions was reviewed and issued. <br /> Mr. Somerville was concerned with who would be responsible for policing and that a <br /> name be provided to the Commission each- year. <br /> APPLEYARD: order of Conditions re-issued due to loss by the engineer. <br /> Amended order of Conditions Issued. Mr. Homeyer stated it is the last <br /> order he will sign for anas-built oversize, Mrs. Simmons agreed. <br /> TIDE : Due to lack of quonun sitting, to be conditioned at the next hearing <br /> date. <br /> Amended order of Conditions issued. <br /> CM=ICATES OF COMPLIANCE: Issued - Lloyd Gainsboro, William Deery. <br /> I I: Certificate of Compliance requested. Upon inspection it was noted the <br /> pier is 170 feet, instead of 147 feet, not including the ramp, and there are two <br /> floats, Mr. Sherman stated the piling may not be legal and is not on the plan. <br /> He suggested the coffnLission refuse the Certificate of Compliance and the extra <br /> footage be filed for* <br /> Mr. Homeyer stated it should be denied and the commission make hint remove it. <br /> Ms Behrran pointed out he Will have to go through the Board of Appeals for the <br /> extra length. if he does not file, an enforcement order will be issued. <br /> VM: Motion made and seconded +that a filing be made for the extra length and <br /> an enforcement order issued if not received. <br /> RICH REALTY TRUST (Gardner) - Request for additional extension. Property to be <br /> restaked -- potential vernal pool. <br /> BEEC WOOD POM: Three enforcement orders were ratified for Condominium owners <br /> for cutting of the area of reveetation. <br />
