OFFICE <br /> The Meeting was called to order at 6:45 p.m. <br /> 6:45 PAMICIA BENWAY, 409 Monor osco Road - hearing under the Town Bylaw for <br /> receipt of butter notification which was overlooked at the previous hearing <br /> that was closed under the state. Letters from Mary T. Francoeur dated 813/91 <br /> and 8/6/91 were read into the record. it was stated the piles are not in the <br /> location shown on the plan. <br /> Nis Benway stated the piles have nearer been moved. She has the ACOS permit; � <br /> nothing has changed. . <br /> Ron F'rancoeur stated the piles were initially positioned not as the new drawing <br /> shows. <br /> Noted that the float with two pilings at the northwest corner is the drawing for <br /> the latest filing. <br /> Mr. Sherman stated when the Certificate of Compliance was requested, it was noted <br /> the float was larger than permitted requiring this filing. The plan for this filing <br /> reflects the dock as it exists today. <br /> Mr. F'rancoeur stated the pilings were moved from this drawing to that at the same <br /> time that was enlarged and built. <br /> Mr. Shennan stated any changes j.n configuration of the float have 'been noted on the <br /> plan which has been submitted to the conmussion. The Shellfish Garden has given his <br /> input and does not see any adverse affects to land containing shellfish. As usual., <br /> the c nm sion has ascertained what interests of the act are affected by this change <br /> in structure and the conclusion was that the interests of the act are not adversely <br /> affected by the changes in- the structure. He stated it was his error in not noting <br /> the lack of green cards. <br /> r. F'rancoeur felt them was a deficiency in the legal notice because it did net <br /> state the pilings were moved after the fact. <br /> Mrs. Sinnons stated if a piling was mored and has not been detrimental to the <br /> environment, the concerns of the c ommi s s i on have been nye t. <br /> Mr. Francoeur stated except the p blIc has not been told they were mored. <br /> Mr. Sherman stated the legal notice is intended as a brief description, not a <br /> complete description of the changes. <br /> Mr. F'rancoeur wished to make the point the size of the pier has been enlarged and <br /> the public was not made aware the pilings were moved after the fact. They were not <br /> physically mored, just put in to hese specs, <br /> Mr. Sherman advised Mr. Francoeur he could appeal to the court under the local bylaw. <br /> The Chairman called for public coments, there were none. <br /> VOM: Motion made and .seconded to close the hearing under the bylaw.
