4 <br /> Board of Selectmen <br /> Minutes-Executive Session <br /> May 5, 2014 <br /> Pending Litigation— South Cape Resort: <br /> The Board of Selectmen discussed with Town Counsel, the matter of pending <br /> litigation vs. South Cape Resort. <br /> Discussion followed with respect to the terms of the Agreement. Upon review, <br /> the Board of Selectmen agreed with the recommendation of Town Counsel to <br /> allow the resort community to maintain the parking area in its entirety, to include <br /> the respective use of 32 parking spaces. <br /> It was noted the Town of Mashpee maintains the right to develop the subject <br /> property including the parking area. However, at this time, the Town does not <br /> have plans to develop the land identified as 966 Falmouth Road, Mashpee. <br /> Motion made by Selectman Richardson to request Town Counsel modify the <br /> terms of Agreement in a fair and equitable arrangement between the Town <br /> of Mashpee and South Cape Resort maintaining the best interest of the Town <br /> of Mashpee. <br /> Motion seconded by Selectman Sherman. <br /> VOTE: Unanimous. 5-0. <br /> Roll Call Vote: <br /> Selectman Cahalane,yes Selectman Richardson, yes <br /> Selectman O'Hara, yes Selectman Taylor,yes <br /> Selectman Sherman,yes Opposed, none <br />
