ConservationMesion
July 26, 1990
Page 3.
There will be a deck at the lower level with another deck proposed above. The
footprint of a deck is proposed. A pervious driveway and drywells for roof run-
off are also proposed. It is parcel. 15, per assessors it is lot 421, The lot
is 50 feet wide and nms to the road from the pond.
Mr. Coffey asked the location of the 100 ft. buffer and was told it is at the
front of the house. He pointed out all the activity, except for the septic
and drive, is in the buffer zone.
Mr. Sherman stated, notwithstanding the fact there has been a problem in the past,
he has reservations with the steepness of the slope, the alteration of the water
service and the project in general. A lot of people have been talking to- Tom
F data to see if there are legal liabilities.
William Jones, an abutter, advised there is a question of validity of ownership
where the septic is placed and under the grandfather law, outside of Title
and current zoning law. Ownership all the way along Timberlane Drive is unknown;
this portion of T,imberl ne Drive has been moved. The driveway will only accomodate
one oar. Parking alongthe street has been a problem. The septic system is up-
gradient from three wells. The whole construction of this dwelling seems to be
fraught with some serious problems.
Mrs. Simmons stated application should be by owner of record.
M . Sherman stated the burden of proof is on the applicant and suggested this be
referred to Town Counsel.
Ms Behrman expressed concern for the steepness- of the slope with 8 Foot clearance
for the water service and an 8 foot wide gulley starting if not stabilized.
Mr. Sanicki stated the water service will go in in one day. He suggested wood
chips could be conditioned. Ms Behan suggested winter rye, silt screens and
appropriate reregetation at the end. Mr, Sanicki agreed.
Mr. Coffey stated ownership is an issue and ground water flow direction is a
serious concern with the water quality of the pond.
Mr. Sani
