On <br /> Mr. egan's last project he cable back with a landscape plan that involved taking <br /> out fill and knocking down trees and building a retaining wall that were never <br /> addressed at the time of the permit. <br /> Evelyn Bushenfeldt, President of the Association, stated Mr. Regan also has <br /> history of putting in paved driveways and doing what he pleases. She questioned <br /> how far back the grandfathering is and what recourse they have as far as building <br /> so close to the pond? <br /> Ms Behnnan pointed out the Building Inspector is Town Zoning Enforcement Agent. <br /> Mr. Sherman stated the only Act that would be involved would be the wetland <br /> Protection Act and under the State this steep bank does not have Performance <br /> Standards written up. -The way it is written, it would be theoretically possible <br /> for someone to build within a foot of the pond. <br /> Charlene Max, an abutter, stated the entire lot is going to be stripped. <br /> Ms Behrman stated, if she 'correctly interprets the pian, everything from side <br /> to side of the lot, between the work limit and the road, will be gone. <br /> Mar. Sanicki stated this is correct. <br /> Mr. Coffey stated there should be a record of what is to be removed. <br /> Mrs. Terry suggested a survey be taken of the number of trees within the 100 foot <br /> radius that are going to be destroyed. <br /> The Commission agreed a landscape plan, as part of the application, would be <br /> required because of past questions in the area and abutters' concerns. <br /> Mrs. Sammons requested information on what trees are to be taken down from the <br /> work l=t, outside of the footprint of the house and septic, <br /> Mr. Coffey requested actual construction procedures to show how this is do-able <br /> with appropriate mitigation, in what sequence, in what location. What size <br /> equipment, where and when, <br /> . Sanicki agreed to provide a complete dissertation from A to Z. The buffer <br /> lime to be indicated on the plan and, other than for driveway, leach pits, <br /> septic tank and house foundation, he will indicate 4 inch trees to be removed, <br /> olTINM TO AURM 231 1990 - :30 P. * <br /> 9:00 JOM MW, Request for Determination of Applicability on a proposal to <br /> replace a sodded lawn and wood chap area with a garden of native and adapted <br /> trees, shrubs, flowers and ornamental grasses at 104 wilann Toad. Mrs. Mayhew <br /> advised she has an artificial wetland, created by a drainage basin, on her <br /> property and she would like to sage it. The pool gets down to dampness by <br /> the end of the summer. There ,is no natural inlet or outlet. <br /> Mr. Sherman advised it is a vegetated wetland under the bylaw. <br /> Mr. Coffey asked if it was certified as a vernal pool and Mr. Sherman stated it <br /> is a good candidate. <br /> on Motion made and seconded to issue a Negative Determination. Unanimous Vote. <br />
