Conservation Commission <br /> August 2 , 1990 <br /> 'age 13. <br /> Mr. Chairman, i s this germain <br /> MR, GLASS: Okay, this is the end of my presentation. We now formally request that <br /> an investigation be undertaken to require that all owners of beaches on Fells Pond <br /> who have sand upon their beaches be accorded the same treatment as we have experienced. <br /> This is not an anonymous complaint, it's coming from Mrs, Glass and myself <br /> MRS. GLASS: And beyond our pond, all New Seabury people who abut any wetlands* <br /> MR. GLASS: We further request (MRS. GLASS: And Mashpee.) that the matter of <br /> defoliation of the property abutting ours be investigated and that civil and <br /> crimnal penalties provided by law be vigorously prosecuted. We ask that any <br /> action concerning our beach be tabled until such time as action is taken on <br /> all beaches, docks and fauna in New Seabury. We will submit these documents <br /> for the file and for your further scrutiny. <br /> C R: Mr. Glass, did you put sand upon the beach with a valid permi t, or not? <br /> MR, GLASS: I put sand on the beach in a mistaken impression that it slid not require <br /> it, I made a mistake, <br /> MRS. GLASS: We bought the property with sand on the beach, just like bark to hold <br /> our hills, it i.s replacing what we have.., We take great pride, as you all admitted <br /> being on our property on a lovely Sunday morning, that we take particular pride, <br /> year after year; we're probably the best maintained lot in New Seabury, if not in <br /> all of Mashpee. <br /> . GLASS: Ie were not aware that sand, which we consider an inorganic matter, <br /> would in any way nourish the pond so we placed the sand upon the beach, eight <br /> tons, approximately three-quarters of an inch, as the environmental impact study <br /> shows, and the environmental impact study further shows that there is no damage <br /> to any of the flora or fauna or�wildlife, as required by state law. We filed <br /> all of the certificates, we paid all of the fees and we just think the thing is <br /> dragging on and resembles more persecution than prosecution. <br /> MRS. GLASS: And cooperation. Here is a manual telling to educate and cooperate. <br /> People don't always understand what is expected of them. You are supposed to help <br /> inform, for cooperation, we are doing that; we would intend to continue to do that <br /> but this is going beyond the norm. Them is something that smells here and we are <br /> not troublemakers, as we told you, we always cooperate. We apologize if this has <br /> created any extra time for your people to spend on when perhaps you could be doing <br /> more important work but I told you then, we will continue this, it will not be just <br /> our beach, it is going to be all of 'ashpee; everybody that abuts any water, any <br /> Wetlands, will be required to 'do the same thing as we. <br /> MR. GLASS: And if you need complaints, we will provide the complaints. <br /> MRS. GLASS: We will make a blanket one. <br /> S : If you make the complaints, Mr. Glass, I will personally investigate <br /> them. Since any charater was brought into question here, I want to assure you <br /> that in my sixteen months here I have never refused to look at a violation that <br /> has been suggested to me and to suggest that 1 have is improper. <br /> SSR. GLASS: What I am suggesting to you is that when you came on my property and <br /> saw my reach, you also saw half a dozen other beaches and if your duties are the <br /> responsibility to assure that that pond isn't destroyed, then it can't just rest <br /> with an anonymous complaint. You have to look at that complainer and say, now <br /> why did that person complain about this beach when the other beach has the same. . <br />
