He did not believe <br /> during a flood stage that it would have been inundated because of the vertical rise <br /> to it, Ashumet Pond's normal elevation is elevation 44; the elevation here is 4 <br /> which he believes to be the natural elevation. He does not believe there has been <br /> any alteration on the land with the exception of the building of the road. <br /> It does qualify as a wetland, 1500 square feet; it does not contain a quarter acre <br /> Foot. This has a fairly small water shed area and does not achieve the quarter acre <br /> foot mathematically, and, given the plant- type there, the size of the wet area, that <br /> doesn't support it either. That is the reason for the RDA. <br /> Their goal is to eventually fill this; they have the obligation to contain surface <br /> water run -off. Their next step would be a more complicated engineering plan based <br /> on the outcome of this hearing. <br /> Mr. Sherman asked for what firm the Bill Richardson report was prepared? Mr. Cauley <br /> stated it was prepared for the client and Benchmark incorporated it with the RDA. <br /> Mr. Sherman pointed out Mr.. Richardson went there once and observed an amount of <br /> water. <br /> 1. That is not adequate and calculations are necessary. <br /> 2. He was there today and altered, whatever it is, in his opinion, <br /> at least under the Mashpee Wetland Bylaw, it is a freshwater <br /> wetland due to the vegetation. It has already been altered; <br /> someone has put a water service in there and he would like to <br /> know who did it. <br /> Mr. Pulsone stated the Town of Mashpee did that. Mfr. Sherman asked, if the Nater <br /> District did it, at the request of whom? Mr. P .lsone advised at the owner's request. <br /> Mr. Sherman stated they have spilled material into the wetland which is a violation <br /> he will pursue. <br /> Ms Behrman advised there is a lot that is just upgradient of this which is a <br /> simlar Situation.
