Conservation Commission <br /> January 25, 1990 <br /> Page 3, <br /> Paul Lel to, environmental consultant, advised he was retained by MrFranchi <br /> to evaluate the Notice of Intent for the construction of the ramp and dock. <br /> The area has five resource areas : Coastal bank, coastal beach, salt marsh, <br /> vegetated land under the ocean and land containing shellfish. The first three <br /> contain vegetation which supplies a very important stability factor. The salt <br /> marsh has been degraded and damaged and to some part destroyed by the existing <br /> structure. It would be appropriate for the Commission to ask for compensation <br /> for the damage. The existing Moat has rested on the bottom in periods of <br /> low tide affecting shellfish. other issues a r the organisms, fin f i sly t <br /> habitat, food for wildlife. It is presumed to be significant. There is a <br /> lot of water velocity in this location and it is favorable for the filter <br /> feeders to obtain food, putting in a structure will change that. He fel <br /> the Commission should request compensation for the damage that has already <br /> occurred. <br /> Ms Behr an requested a resume of Mr. Lelito' s background which he provided. <br /> Mr, Coffey asked Mr. Lel ito, after seeing the proposed dans tonight would he <br /> change his recommendations or comments. <br /> Nor. Lelito stated the changes proposed, are a distinct improvement and it will <br /> not damage the salt marsh as it has in the past. <br /> Mr. Sanicki agreed with Mr, Lelito' s report and existing conditions. The <br /> proposal before the commission is a viable solution. <br /> Ms Behrman questioned the spacing of the boards on the existing deck and Mr. <br /> Sanic i suggested the commission could condition 1" spacing. <br /> Copies of the revised p1an to be submitted. <br /> Mrs. Simons stated the project would be taken under advisement. <br /> CONTINUED TO LARCH 22, 1990 - 8:00 p.m. <br /> Ir. Kobe asked if fir. Fran hi would be allowed to submit regarding the neer <br /> plan submitted tonight and was told he could. <br /> 7:45 Richard Coffman, for the construction of an addition to ars existing <br /> dwelling at 167 Whippoorwill Circle. Atty. William Henchy presenting. <br /> Ms Behr man stood down. He advised a special permit was granted by Board of <br /> Appeals for construction within 50 ft, of the coastal bank which has been <br /> appealed to Superior Court by a neighbor. <br /> It was noted Town Counsel suggested this be continued 6 months - 1 year, <br /> pending outcome of the appeal , At that time the Commission could consider <br /> new information or deny without prejudice. <br /> Mr. Henc by advised abutter notification did not go out until Monday of this <br /> week and return cards not received back.
