Conservation Commission
January 2 , 1990
Page 5.
8:45 Alfred Bfaro, for the construction of a dock, float and ramp, and
maintenance of existing walkway path at 64 Sa oset Road. Patrick Coffey and
Louise Behrrman stood down. William Hendry, John Sl vinsky, Bob Gray of
Sabat i a and Mr. Bafaro were present. Mr. Hendry advised concerning an open
previous filing, it has been appealed and Nor. Bafaro would prefer to leave
it open*
Mrs, Simmons stated it will have to be addressed at a later date.,
Mr, Henchy advised abutter notices were sent out Monday with no returns. He
asked permission to go forward with his presentation and thea have the hearing
put over to receive the green cards back or renotify. The Commission agreed.
There is a revision to the plans dated January 19 showing a proposed well ,
electric line and haybale silt line adjacent to the bank.
Mrs. Simmons stated this was staked and visible at the on-site.
Mr, Henchy advised the only machinery is a backhoe to get the well in and other
than that it will be an 18" trench to be dug by hand.
Mr. Burns questioned removal of 'any trees. fir. Slavins y stated it will not be
necessary, they will go around any trees in the way.
Mr, Henchy stated it is proposed to construct a dock with a float at the erg
going off the top of the bank leaving head room of ' at the shore line for
passage. There will be a minimum of ' of water at Mean Low Water at the end
of the float. Ten pilings are to be driven in place along the edge of the dock
and two at the end of the float. n extensive shellfish survey was dome by
Sabatia; the major issue is the shellfish.
Bob Gray presented copies of the surrey dome on April 2, 1.989 to determine the
extent of soft shell clams, quahogs and any bay scallops and to assess the
general area for any locations of eel grass. The area was divided into an
intertidal and subtidal zones He reviewed the surrey for the commission.
It was determined in the subtidal deeper zone D theme were about 120o quahogs.
In intertidal zones ABC, softshell clams and quahogs were found; Softshell -
2.75 per quarter square foot, which is over the Dept. of Marine Fisheries
trigger of 1 .55 per quarter square foot; Quahogs -- 1 .55 per quarter square
foot, the trigger is one per square foot.
The mean standing property is calculated to be 16,500 f sh ll , adults and
seed, Quahogs standing c rrop i s 9,300.
The Dept. of Marine Fisheries trigger has been exceeded. The area has a habitat
value which would support softshell and h and shell clams.
The Shellfish warden stated he does not feel the square foot quadrants give a
reasonable degree of accuracy, he suggested square meter quadrants. He would
classify the area as a shellfish bed as opposed to the shellfish area and is
very definitely a habitat for softshell clams and quahogs. There is considerable
seed and bay scallops set in the area from time to time. Eel grass is not a
major factor. His major concern is the location i n the middle of a shellfish
bed. The potential use impacts of the project will weigh very heavily on the
productivity of the shellfish resources in the area. He could not see anything
good coming from this project- the use of the pier is unknown. I will have to
be assured that the ill be 9 rotor buts and prop wash will be a major problem
with juvenile shellfish. Setting time is in the summer.
