Conservation Commission <br /> February 22, 1990 <br /> Page 6. <br /> Porciel.lo/West: Norman Hayes presented a copy of "Guidelines for Dock & Pier <br /> Construction in an ACBC", He asked that the Commission reconsider reopening <br /> the case. The previous attorney has been dismissed for failing to notify the <br /> commission. Mr. West was not aware that the hearing was unattended; BSC had <br /> ended their contractual obligation. <br /> The Commission had thought it would be necessary for an FEIR to be done. Based <br /> on guidelines and discussions with CZM officials, floats at are absent in the data. <br /> An ACEC, in order to have an FEIR mandated, needs to have a state permit required, <br /> They have a. mooring permit from the harbormaster and a permit for a walkover <br /> structure. They feel a sounding will show putting an aluminum connector to the <br /> float will not create any impact other than shading on a seasonal basis. Because <br /> it is a bottom anchored float, no Chapter 91 license is required. <br /> Mr. Hayes stated if the Commission requires an ENF, even if not required,, th y <br /> would be in a. position to go ahead. They understand the sensitivity ofthe <br /> Jhu Pond issue. This has been discussed with Mr. West. <br /> TE: Motion made and seconded to reopen the hearing. <br /> Abutters will have to be ren of ied and Mr. Hayes will provide a copy of a <br /> shellfish study. <br /> Mr. Sherman questioned the issuing of ars order of Conditions with an ENF pending. <br /> Ir. Mayes stated any order of Conditions can be tailored to meet the EN�'; he <br /> agreed to get an answer concerning issuance. <br /> Mrs. Simmons stated. the Commission will discuss at the next hearing what will be <br /> expected of Mr, West and notify Mr. Hayes., <br /> Concerning John Lower, sB --382, Mr. Hayes advised there was a maintenance <br /> standard. The coastal bank has taken a, beating, the haybales are now in the <br /> holes. They will be coming in with the beach nourishment material put on top <br /> of the bank and planted with american beach grass; 18 on center, 3 to each hole, <br /> All interests expressed in the original denial will be addressed. The material <br /> will be put down when they do the nourishment. <br /> Certificates of Compliance: New Seabury Beach Nourishment* Maushop Tillage. <br /> Orders ofConditions: Yahan YaYlaian - Issued. <br /> Scolavino: After discussion and review of the dans, Ids Beh m.an made <br /> the motion and Patrick Coffey seconded to prohibit the 10' X # float because <br /> it is covering shellfish. Louise Behrman, Patrick Coffey. <br /> It was noted the plans were not stamped and therefore not acceptable. Mr. Costa <br /> to be contacted, Aai ing stamped plans, <br /> Bl.ega.nte Enforcement Order: A letter from Kevin Melkonia.n was read.
