Conservation Cossion <br /> February 22, 1990 <br /> Page 5. <br /> The Comission has been asked by Robert Sullivan to act as judges. of a decorated <br /> boat parade on June 23 at John's Pond with the theme "Save the Pond". <br /> Santuit Woods Realty Trust at Winslow Farms: Additional Siltation Control to be <br /> addressed. <br /> VOTE: Motion made and seconded that a, Notice of Intent will be necessary. <br /> Mr. Sherman to verify whether individual notices will be required. <br /> site report format was reviewed. To be amended to show previous enforcement <br /> action. <br /> Enforcement Issues <br /> Colsch-Monomoscoy: Cutting outside the buf'f'er and putting in the marsh. Mr, Sherman <br /> advised the gentleman is elderly; there was no malicious intent. Be suggested <br /> letter be sent that this must be removed. <br /> VOTE: Motion made and seconded to follow the recommendation of the Agent. <br /> Smith-Monamoscoy: A trench dug from the house to the marsh with PVC pipe placed. <br /> Mr. Sherman suggested a, letter be sent that this must be removed and filled or a. <br /> Notice of Intent will be required. <br /> VOTE: Motion rade and seconded to follow the suggestion of the Agent. <br /> Stenberg: Mr. Sherman advised Town Counsel feels if mitigation can be done with- <br /> out the notice by ordering and observing and it will be brought into compliance <br /> the Commission can waive the Notice but require a revegetation plan by a certif led <br /> .professional landscaper. <br /> Ms Behrm n stated there must be a, bond so that the vegetation will be properly <br /> maintained,. ' She questioned what would occur if the property were sold without <br /> an Order of Conditions. <br /> We Sherman advised with the new NCD, the Commission can write any mitigation <br /> program and -failure to follow up can still be fined. <br /> A plan by a certified professional landscaper will be required and it must be <br /> implemented in this growing season. <br /> ontieri : A revegetation plan was reviewed for an Amended Order. They want to <br /> extend a, wall 3-4 ft, to the bottom and bring the stairs down, <br /> Ms Behrraan questioned the date the Order was issued. <br /> Receipt was requested showing the request for amended order was sent to D.E.P. <br /> It was stated Mr. Pontieri' would proceed at his own. risk if continuing during <br /> the 10 day appeal period. <br /> Mr, Sherman asked if the C ommi s s i on addressed the revegetation plan where trees <br /> were removed -$' .beyond the work limit. It was agreed this was adequate. <br /> Mr. Sherman will work out a timetable for the revegetation with Mr. Pontie i. <br />
