Conservation Commission <br /> February 22, 1990 <br /> Page 4 <br /> 9:00 NORTON PIERCE for a Determination of Applicability on a proposal to remove <br /> an existing well and install a, new well at 54 Captain'sRow. Susan Asmus presenting. <br /> The proposal is to remove an existing well and relocate it closer to the wetland <br /> resource which is Mean High water of Shoestring Bay, an addition and upgrade of <br /> the septic will be within the buffer zone, v-1 , elevation 1 , A rubber-tired <br /> backhoe with a. narrow bucket will be used to dig the service line, a, 4' path at <br /> the most. The old well will be left, if possible, and if not the same equipment <br /> will be used to remove it. All debris to be taken off-site. Haybales are to be <br /> placed prior to any work and will remain throughout construction. <br /> Mr. Coffey asked if they plan to revegetate the lime areas and was told it is lawn <br /> and they will put lawn back. There will be approximately 100 s 18 ft. of disturbed <br /> area., or less. <br /> Mr. Sherman stated he had no problem with the project, <br /> VOTE: Motion made and seconded to issue a negative determination, <br /> LEGATIVE DETERMINATION <br /> 9:15, NORMAN SHILLER for the demolition of existing structure, removal of orae-half <br /> of the existing foundation and deck after -the fact and reconstruction of dwelling <br /> on existing footprint with 241 X C' addition and deck at Lot 11 Punkhorn Point Rd. <br /> John Jacobi advised this is an amended filing; original order of Conditions and plan <br /> showed -there was an existing house with proposed addition. The house, built in the <br /> 1.90's was riddled with carpenter ants, The owner indicated to the builder it would <br /> be preferable to start anew and knock down the building. The deck, house and two <br /> foundation walls were taken down and they built on the original footprint. <br /> Mr. Sherman stated he did not see a problem at this point. <br /> Mr. Coffey questioned the haybal.e detail and specifications. He is concerned with <br /> trenching of haybales except in a real extreme situation. <br /> Mr, Jacobi stated they are normally just staked and backfilled; this project will <br /> be staked, not trenched. <br /> CLOSED - ORDER OF CONDITIONS IN 21. DAYS <br /> -A letter of thanks from Ellen Shepherd was read. <br /> The South Cape Beach Advisory Comm to meet with the Selectmen and D.E.M. on <br /> March l at 7:30 to take up the -issue of Great Oak Road. <br /> Commission Member Liability: Leslie Morse advised anyone can sue, but must prove <br /> conspiracy or malice of forethought. <br /> Abutter Notification: Mr. Sherman suggested 3001 be the rule in cases where <br /> controversial or large scale, etc. and as a. norm, 100 ft.. or immediate abutters <br /> for RDA's. To be discussed before the next special town meeting. <br /> A copy of the Ton of Dartmouth regulations will be secured for comparison, <br />
