If a beach area was to be created It would be <br /> separate filing. Ender the act, 20 the shoreline is allowed to be used. <br /> Mr. Coffey asked. that the issue of the wells be addressed and was told the <br /> Health Board requires that the wells be discontinued with town water hook-up. <br /> He stated there should be no lawn within 100 feet of the pond and Mr. Costa <br /> agreed. <br /> Mr. De rosiers. felt with 200 sq. ft. of roof there were not sufficient drywell . <br /> Mr. Costa agreed another two could be pint in and changed the plan to show four <br /> dr wells. <br /> Mr. Halpern stated he had no problem with the project. <br /> COM=S <br /> Bill Martiros, an abutter, stated there are discrepancies on the lot lines, <br /> 14 feet on one side and 5 feet on the other. Mr. Costa stated the subdivision <br /> plan has an error in it. The deed says by the shore of the pond. <br /> Mr. Coffey pointed out that this is not within the purview of the Commission$ <br /> Mrs. Bonin, an abutter on the other side, stated she objects to the house being <br /> built so close. Also, nine trees of substantial size will be chopped down. <br /> Erosion is now occurring. She asked if gore is a hardship reason. <br /> Mr. Costa stated they do not have to show hardship and are within the boundaries <br /> of the law. The deck will be slightly back from the house on either side. <br /> Mr. Halpern stated -he had no problem with this. <br /> Mr. Costa suggested if Mrs. Bonin has a problem with erosion, she should have an <br /> engineer look at her house. she stated she still felt the house should be moved <br /> back; it would be better for the trees to remain there. <br /> Complaint was rade that view would be blocked and Mr. Sherman advised blocking <br /> a view is not an interest of the Wetland Protection Act. <br /> HEARING CLOSED - ORDER OF CONDITIONS IN 21 DAYS. <br /> 9:15 New seabury Co.
