Conservation commission <br /> May 31 , 1 990 <br /> Page 3. <br /> Mrs. Simmons asked what would happen if they didn't put the sleeve in and gust <br /> put the pipe in? Ms St.Pier a stated it wouldn't hold. <br /> Mrs, Simmons asked why not, if only for the summer? <br /> Mr. Halpern also questioned why it would not hold, .with a 4 inch piling? <br /> Ms St,Pierre stated it is an 80 ft, long structure. She advised she is not -an <br /> engineer and can't speak to whether it would hold or not. <br /> Mrs, Simmons pointed out Ms St.Pierre had stated there is no wave action there. <br /> She agreed , but asked how they would get the piles into the ground, <br /> Mr. Burns stated they could dive them. She asked why that is different than <br /> putting in a sleeve. She stated that would be agreeable to them, driving the <br /> piles. <br /> Mrs, Simmons stated there is no maintenance in the Order, the Commission would have <br /> to amend for maintenance. <br /> Mr. Sherman pointed out it could not be amended for maintenance as the order has <br /> expired, Ms St.P i erre stated the order has not expired, Mr. Sherman reiterated <br /> the original order has expired, She argued it has not expired, it is a recorded, <br /> legal order. Mr. Sherman advised all orders of conditions expire in three years. <br /> Ms St.Pierre stated everyone has to abide by the order of Conditions,, whether it <br /> is 3 years or 20 years. <br /> Mr. Sherman asked, but did the order of Conditions provide for maintenance's She <br /> stated it doesn 't. apparently, so they would like to amend the order of Conditions <br /> to provide for that. <br /> Mrs. Simmons suggested this be referred to D.E.P. <br /> Mr. Halpern stated in the Notice of Intent it says a seasonal pier that comes in <br /> and out every year. <br /> . Sherman asked if that meant the piles are driven in and out every ,year? <br /> Mr, Halpern stated with most seasonal piers, they take the piles in and out; most <br /> piles in a seasonal pier aren't 4 inch, most times they are 2 inch and 2 inch piles <br /> are easy to put in and take out. <br /> Mr. Sherman suggested, the Commission is not averse to this, but is trying to stay <br /> within the same consistent rules D.E.P. has given to them. He offered to contact <br /> D.E.P. and c M to see what their feeling is. This is not a typical situation. <br /> Ms St.Pierre stated if that is the direction the Commission wants to go in, she <br /> would have apprep faced getting that direction two weeks ago when she called <br /> because she thought this night happen. They do not want to lose any more time. <br /> She advised she wants to submit a Notice of Intent which would have to be in <br /> the next day to meet the ret public hearing agenda. <br /> Mrs. Simmons asked if she would want to contact D.E.P. herself? <br /> Ms St.P i erre stated no, that could take months. Mr, Sherman pointed out it does <br /> not take months to contact D.E.P. She advised she deals with these agencies on <br /> a daily basis. They would prefer to ,just file the Notice of Intent, She has <br />
