Conservation Commission
May 31 , 1990
Page 4.
prepared one phrased as an amended order of Conditions. If D.E.P. disagrees with
that, they can so state that; she would rather do it that way.
Mr. Sherman asked if she wanted to do it as an amended order and see if it is
acceptable to D. .P. Ms St.Pierre stated that is ghat they would prefer to do.
The Commission agreed.
.Mrs, Simmons stated there is no reason the Commission would want to prohibit
1r. l arrioti s from m ha vin what he has had in the past.
Mr. Coffey stated , if 2 inch or 4 inch piles, replacement, were driven it would
then cover the spirit and essentially the letter of what the Commission has and
get - it done fo.r this season.
Mr. Sherman advised the 2 inch, 4 inch, or S inch, or whatever, has nothing to do
with the Commission; that's chapter 91 . The guidelines from D.E.P state,, if you
drive new piles,, sleeves, piles, whatever, and you don't have it in your order of
Conditions, or Certificate of Compliance, it calls for a new Notice of Intent and
he is just trying to be consistent because there are more of these coming up and
if the commission goes one way one time and another way another time, the comm-
ission will be open to a lot of critici m.
Ms St. Pierre stated she understood.
It was noted the order was amended to clarify a mistake re footage, The structure
is 80 feet.
30 VINCENT P P IELLO, JP. , 9 Tide Run Way, Continued hearing.
CONTINUED To JANE 28s 1990 - 7:45 at the request of the applicant, The appeal
has been withdrawn by BSc.
7:31 FRED LU O I, to remove an existing pier and construct and maintain a 41 X 60,
pier, 31 X 12' ramp and 81 X 16' float at 30 Sand Dollar Lane. Todd Palmatier
presented revised plans. There is an existing horse and pier., He listed the
identified resource areas. The coastal bank is very low and really does not
ret the definition but does afford a small amount,
The existing pier is shown in the dotted configuration; it is very lour, narrow ars
rickety, The float i s oriented perpendicular. It will be removed by hand, cut off
at/or below ground level . The pier will begin at the top of the coastal bank.
There are good ties that will be left. From the top of the bank the pier will
extend 60 feet out over the salt marsh and -over the tidal flat. There wi l l be
new ramp constructed and connected to the end of the pier. The float will be
oriented to crake a "T" configuration, Piles wi l l be " X " installed by hand
through the salt marsh and driven, out in the bay. 10 inch piles will secure
the float, CCA treated. The decking was to be 2 x 8 and was changed to 2 x 6.
3/411
spacing will be used. The new plea will be over the same location and no
vegetation will be removed. It will be elevated over the bank to encourage growth
beneath and elevated 5 feet over the salt marsh. Turning the float will reduce
prop wash and turbidity. 'A special Board of Appeals permit is in hand.
Mr. Burns asked if this went before ACOE and was told not as yet. He stated they
have to give access beneath. Mr. Pal mat i er stated there will be 5 feet, or more,
of access.
Mr. Sherman stated this is much improved over ghat is there, Paul Somerville
has no problem with the design.
