r i <br /> CONSERVATION COMMSSIO <br /> Meeting of November 8, 1990 <br /> Commissioners Present: Patrick Coffey, Renee Fudala, Harry Desrosiers, <br /> Frank Homeyer,. <br /> The meeting was called to order at 7:15 p.m. <br /> Leigh Potter, herring warden, came before the Commission. He is seeking a map of <br /> the Mashpee River. He presented a copy of a letter from Bon Bourne of the Littoral <br /> Society to the Soil Conservation Service asking for help at John's Pond at the start <br /> of the Quashnet River. He is willing to help with engineering on the two ladders <br /> and groin, with some actual construction funds and publicity. <br /> two day workshop is planned for sometime in February regarding river protection <br /> in general, <br /> Mr. Sherman advised the willow trees blocking the river have been discussed. At <br /> some point, it will be necessary to go in with a machine to clean the growth. He <br /> did not feel the Town Herring fisheries could be given an a uacultural exemption. <br /> In a Notice of Intent process, the town fees and town's portion of the state fees <br /> can be waived. However, there is no waiver language in the bylaw for abutter <br /> notification and this will present a problem with three areas in the river involved. <br /> Mr. Potter advised the largest area is behind River Bend. <br /> Mr. Coffey stated the actual procedure is important also, how sediment slugs and <br /> water flow are addressed. <br /> Mr. Sherman suggested he and Mr. Potter go to DBP for some answers. He asked the <br /> actual area to be involved and was told one is thirty feet long and no area would <br /> be over thirty to forty feet. <br /> In conclusion, Mr. Potter advised they will, be meeting Sunday at the flume at <br /> 11:00 a.m. to look at the areas involved. <br /> Mr. Desrosiers asked if other towns had been contacted for input as to how they <br /> have handled this sort of probleri <br /> Mr. Potter advised Bora Bourne was to research this. He had suggested advertising <br /> it as stream maintenance, <br /> Bob Gray is to be consulted re the process of shutting off the water overnight and <br /> a good part of the day and what ging it back on will do to sedimentation. <br /> WILLIAM AST, Daniel's Island Road: The builder called regarding changing- the <br /> haybales and mentioned demolition of the building. The file and minutes of the <br /> Commission and Appeals Board were reviewed and here is no mention of demolition. <br /> It appears this came about when the builder became involved, <br /> Mr, Sherman felt, at the very least, here should be an amended order and it has <br /> been suggested by some officials that a new Notice of Intent should be filed. . <br /> policy guideline concerning amended orders was reviewed* He feels the scope of <br /> the project has changed in nature and scope; the potential for adverse impact has <br /> changed as there is a lot more material to be disposed of. ' Town Counsel was con-- <br /> suited and is of the opinion that an amended order should be required at the very <br /> least. He felt it was inappropriate for hire to suggest that we should have inferred <br /> there would be demolition. <br />
