He should be familiar with the <br /> wetland laws. <br /> Mr. Sherman stated there is no doubt there are wetlands and a filing should have been <br /> made under the provisions of the bylaw, which has changed in the interim. If there <br /> are fertilizers in the hydroseeding, he suggested perhaps the board of health should <br /> be involved. <br /> Mr. Coffey stated if the enforcement order is issued, it is issued with the under- <br /> standing you are free to proceed with the hydroseeding. It is a clear and present <br /> danger you will be liable to mitigation, clean up, rectification and redo if nec- <br /> essary. <br /> Mr. Falacci apologized and stated he meant no disrespect to the commission. He <br /> does not have expertise with delineations. It is not his issue to dispute, he <br /> only came in for an update. <br /> Mr. Coffey stated a wild flower mix may be better than kentucky blue grass. <br /> Mrs. Simmons seconded the motion made by Ms Behrman. <br /> VOTE: Motion made and seconded to issue an enforcement order to require the filing <br /> of an after-the-fact Notice of Intent within two months to condition maintenance <br /> and look at the amount of fill deposited and where deposited. Unanimous vote. <br /> Mr. Falacci agreed and will file. <br /> 8:00 ANTHONY E. FERRAGAND, for a determination of applicability on an existing gravel <br /> walkway, 5' x 8' wood platform, and proposed ongoing maintenance and vista pruning <br /> within bank area at 87 River Road. Mr. Ferragamo advised a gravel walkway was in- <br /> stalled under the original order of conditions but was not specifically conditioned. <br /> In the process of doing the work, he -installed the walkway as Item #7 in the area <br /> regarded. The limit of work was 21 foot contour. When grading was done to accomo- <br /> date the house, he planted sheep fescue. There is foot traffic to the dock and <br /> previously constructed stairs down the bank to the dock ended. He is proposing <br /> a ramp over the bank. He requests on-going maintenance and vista pruning on the bank. <br /> The original order of conditions was very liberal; he could have wiped everything <br /> out on the bank. He did pruning and is now getting back all the little suckers. <br /> In Item #3 he states, if as a result of any of those activities any vegetation is <br /> killed he will immediately replace it. <br /> Mr. Coffey stated how, and what, you replace anything with is a concern. <br /> Mr. Sherman stated specificity is necessary on the pruning. He did not see any <br /> detrimental effects from what has been done. <br /> Mrs. Simmons felt the platform would be an improvement. <br /> Mr. Coffey asked if the gravel walkway would require maintenance and was told it <br /> would not as the gravel is retained. <br /> It was suggested Mr. Ferragamo provide a written paragraph of what he intends for <br /> vista pruning. He agreed and would return after the next hearing. <br /> 8:15 DIANE L. CLICK, Lot 62 Keel Way, for a determination of applicability on a <br /> proposal to remove brush, prune trees and placement of wood chips. Tom Kelley <br /> presented abutter receipts.
