The minutes <br /> were read and accepted. <br /> ti <br /> First on the agenda was a bill from Marcel 11"i tin in the amoant o <br /> $325.00 in the Thomas Paradise case, with..a vote being asked for approval. <br /> Iwas said that the � <br /> case hasn't been settled yet anc a ., o, that ;it <br /> doesn't say $Final Bill". We are waiting' to find out if they're in t <br /> issue ars Order of Condition. I.irs. Sloane wanted to kn' r if that is a state <br /> decision and the answer was in the affiridgiative. Wecan still aDpeal it. <br /> 14ir. Kistin feels we're going to lose the case. We're waiting for a de- <br /> cision - we probably won't receive another bill on this. This bill goes <br /> to the Selectmen to be tai en From Legal and Engineering Account. Barbara <br /> Sloane moved that we pay the bill, seconded by Jin LeCl a.ir so approved. <br /> Mrs. Studley presented a Public I.Totice issued by theDepart-lent of <br /> the Army ori r the proposal of Robert Hoi,i yer who leas requestedperr it under <br /> Section 10 of the River and Harbor kct of 1899 and Section 404 of the Ped- <br /> oral Water Pollution Control. Act Amendiments of 1972 to: Retain 228.5 linear <br /> feet of existing unauthorized concrete bulkhead and to construct and srlain- <br /> t in 30 linear feet: of concrete block bulkhead to complete the existing <br /> bulkhead and replace eroded fill in the <br /> Great ger at �ka.sh�ee, Mass. in <br /> accordance with the attached plans. Approximately 10 cubi -yards of sand - . <br /> and gravel will be placed shoreward of proposed bulkhead. The area is to <br /> be used as a beat basin. (Full copy attached. <br /> He has not filed Notice of Intent and only seat this thing to the <br /> Corps of Eng veers. Mrs. 1 eLory wanted to know how come he filed after <br /> all this time. He originally filed Prior to the Wetlands Protection Act <br /> being given to us. The existing bulkhead waslied for through the <br /> Selectmen. It was asked if he ever had a Corps' <br /> p g <br /> of Engineers permit - <br /> apparently not. It was asked that even though it's an existing thing., do <br /> they t�ll have to come to us. They still have to come to us for an Order <br /> of Condition. They're trying to bypass the local authority. Corps of <br /> Engineers is ordering them to comply with local authority. <br /> The pl n' was looked at and discussed and it was stated that there 's <br /> no way we Ire going to have a marina in there.{ <br /> M .
