She suggested that Mr, Buckingham get a ruling from Town Counsel d- it has already been ruled as a Town Forest - she asked if your can designate the .sane area for a different use. Mrs. De ory thinks it could have to come before TownMeeting, I . Buckingham said that it can still stay in Conservation's hands, adding that he will get through the legal- ities of it. Mrs.. Sloane asked if Henry Godleski l s Civil Defense Report should' be included in the minutes of this meeting and the answer was ire the affirma- tive. (Attached. ) Mrs. Sloane said she asked Harold Collins about the hou e that's being built in Surmer Sea (Bruce Fulton), adding that he 's very close to wetlands. . Buckingham said that his septic tank is an near the road, adding that his building plan went in years ago and he got extensions because of the suit - this goes back 1 years before the suit started. Firs. Studley menm. tinned that the Wetlands Act has been in since 1972 and building now comes under the Act. Mr. Buckingham reiterated that he is- within 1001 of water, but his septic system is well beyond the 1.001 . Mrs. De ory asked where Mr. Smith's septic system is going and Mr. Buckingham said it was going in up the road, adding that his house will be within the setbacks required by Planning. His septic system will be back on the road and will be a diffuser. Mrs. Sloane mentioned that the docks are going to present a problem that just in her marsh there are several_ that have to be replaced or re- paired. She also said that if the Wetlands Act went in in 1972, thew that means that Ed Gargiulo built in 1963 and never got permission for the dock � and if he wants to do any repairs,, he doesn't have to come in to the Como- mission, mo- i ion, but if he wants to build a new one, he will have to come in to the Commission. Mrs. Studley asked if -he had a permit from the Cons of Engineers or Board of Selectmen. Apparently there is, downstairs, -axe envelope full of special hearing notices that were held when the permits were given out b the Board of Selectmen and they have to be sorted out. Mrs. Sloane said that when these people start with their hammrs hamand saws, there is going t e a problem. Where was a brief discussion on the possibility of mailing out rules and regulations pertaining to Conservation, Waterways and Shellfish to all residents. It was suggested- that these rules and regulations could pos- sibly be included with the tax bills, but this was ruled out.
