t <br /> Conservation Commission's { <br /> minutes of May 25, 1983 Page <br /> Chairperson Studley- asked Selectman Hanson if he had auggestion to offer <br /> the Commission Selectman Hanson replied that he knows the powers of con- <br /> servation in the town: however, he did not know the powers of conservation <br /> when you are dealing with conservation. He asked the Commission where they <br /> stood if they objected to thea using the lower- parking lot? Charlie re- <br /> plied that the commission could call for a hearing, thea go for a 3ud,iczary <br /> hearing and then to court if still not sati9fied" Chairperson Studley asked <br /> what sort of leverage the South Cape Beach Comfnittee has Selectman Hanson <br /> replied that they can stop it but as far as he is concerned I everybody on that <br /> committee 3ust mods their head to the State as they, have worked so hard for <br /> the State to take it. Selectman Hanson commented that if the State is going <br /> to take it, -we should rake sure it- is done right. He said that they appeared <br /> before the. Board of Selectmen to make sure that there were no problems as <br /> Chet, had concerns about the roam and some of the things that they were plan- <br /> ning to do. He c rhmented that their parking lot was going to be right in the <br /> middle of the town owned road, Chairperson Studley commented that she thought � <br /> the problem had been resolved. Selectman Hanson replied that it has been re- <br /> solved because they are going back down on the beach with their parking lot. <br /> He said that the road problem seems to be running true to form according t <br /> where the actua1 . layout calls f o r. Chairperson Studley told Sel ctman Hanson <br /> that the Commission would send a letter to the State, <br /> S lectman Hansom a1s6 asked if there would be a member ber from the Conservation <br /> commission that would be interested in being an associate member to the South <br /> Cape .Beach Committee. He said that he felt it was important as there is n <br /> communication between the two committees. <br /> Hearing for Luciane C. Navazio, 274 Taffrail way <br /> r. Doyle from Doyle Associates and Mr. Irving ging were present for the <br /> �� <br /> ear ing. <br /> . Doyle explained to the Commission that the lot was previously before <br /> he Board for approval- of the location *of the house and now Ms,, Navazio is <br /> roposing to build a dock. He explained that the area is coastal, which <br /> hurts land and r the ocean and lard containing shellfish. He explained that <br /> hey propose ars elevated walkway over the salt marsh to be constructed with <br /> ne inch plank ng:--to ' lleviate the blockage of sunlight from the underlying <br /> egetation. The placement of the supporting tales shall be by the hydrojet <br /> eth d with minimal al damage to the salt marsh. Mr. Doyle addressed the area <br /> nder the salt pond stating that the work they propose to do will have mini-- <br /> al ffect on 'the marine fisheries habitat during the placement of treated <br /> Iles. He said that they would be oth:er than creosote and placedat- <br /> mini- <br /> um <br /> nn - <br /> um spacing of f bet. The area of land containing shellfish was also a - <br /> ressed. Mr., Doyle told the Commission- that due 'to the eight foot spacing <br /> the pilings, that there would be minimal adverse effects upon the produc- <br /> .ivity of shellfish due to pollutants nor alterations of water circulation. <br /> Tota ion was made that the dock is shorter than what the Commission requires <br /> r the maximum, <br /> harlie asked if the ramp and float would be removed during the winter months. <br /> r. Doyle repli d that they would be removable. Charlie noted that there would <br /> e room to store the ramp and t1oat on top of the bank <br /> auline told Mr. Doyle that the shellfish would have to be replanted in the <br /> area if found. <br />
