Mr. Devane explained that there is a lot of <br /> activity in the Barnstable Road end as the 18th hole is in the area. <br /> Chairperson Studley asked if Mr, LaCava would be willing, to swap the land rather than <br /> the town granting an easement. Mr, Davane replied "yes" and that the Board of Select- <br /> ren suggested a complete swap of land. <br /> Pauline DeLory moved that the Conservation Commission advise the Board of- Selectmen <br /> through the Executive Secretary that it is the Commission's wish that the article with <br /> reference to the exchange of land be worded or amended to read: "an exchange of land <br /> rather than an easement", March Dardano seconded the motion. All present were in <br /> favor. <br /> Request for Determination of Applicabilit <br /> Mr, & Mrs, Kane net with the Corrmis ion to clarify their position on their' request for <br /> determination of applicability of wetlands on -property owned by hirmt'on Wheeler Road. <br /> He reviewed the problems that his letter had with the mail. He -said that,of ter the <br /> letter was finally received by the Commission they wrote' to -him stating that a filing , <br /> of Notice of Intent would be preferred. , Mr. Kane said that he wanted a determination <br /> from the Commission on their form and upon contacting Dom, they suggested that he <br /> follow an app al process. <br /> Mr. Kane expla*ned to the Commission that the intent is to build a home beyond the <br /> buffer zone which is 140 feet from water. The reason that the determination of appli- <br /> cability was sent was to clear selected trees so that he could get a view to the <br /> water. -He explained that the area consists of heavy brush and dead trees. Chairperson <br /> Studley commented that there was no definition on the plan of his .intentions and that <br /> there were no measurements as well.. <br /> Chairperson Studley asked Mr. Kane where the septic system of the house would be loca- <br /> ted, Mr. Kane said -that the septic system would be 80 feet from the road and that the <br /> well would be 100 feet away. He ,said that the perk test was already done. <br /> Chairperson Studley asked Mr. Kane what he meant by removing crown cover as stated in <br /> his determination request. Mr, Kane said that 'he wanted to trim teees so that he <br /> could get adequate sunlight and to have access to the water by way of a beaten down <br /> path <br /> Wayne suggested that Mr, Kane start with the removal of dead trees and thin weak trees <br /> and then prune trees that are good and to make sure that he does not remove root sys- <br /> tems, Wayne moved to accept Mr., Kane's determination in that he need not file, <br /> Pauline seconded the motion. All were in favor. The Commission discussed the fact tha <br /> notification of Mr. Kane's request for determination must be placed in the newspaper in <br /> accordance with Section 10.05 3 (b) 1 of the wetland regulations, This will be done <br /> and a formal hearing will be scheduled for the next Conservation Commission meeting. <br /> Order of Conditions - John Malloy,, 156 Whippoorwill Circle <br /> The Commission wrote up the following Order of Conditions for the above--referenced <br /> property: <br /> The work shall be in accordance with plans submitted to the Mashpee Conservation <br /> om mi s ion. <br /> r <br /> a' <br /> sy <br />
