Mashpee Conservation Commission <br /> minutes of April 25 , 1984 Page <br /> eari <br /> Inc of Malcolm Portnoy <br /> The following hearing on the Notice of Intent filed by malcolm <br /> Portnoy to construct a hone on an existing foundation located at <br /> Lot 8 Sunset Circle was held with Charles Spohr representing the <br /> applicant. Mr. Spohr presented a letter of permission from <br /> Mr. Portnoy which was read into the minutes. He said that he <br /> filed Form 3 originally; however, DEQE felt that Form 4 'is more <br /> appropriate. He referred to DEQE recommendations that sec,. 10. 57. 2 <br /> be viewed relating to isolated land subject to flooding. Nin, Spohr <br /> said that he had sent notices to twenty-five abutters within a 300 <br /> foot radius. He explained that the Board of Health had been contacted <br /> and that the perk test was valid and that Mr. Collins, the Bldg. Inspec- <br /> tor, had approved the existing foundation. Mr. Spohr said that Krs. <br /> Anderson insisted that they certify as to the wells and sewers location <br /> n--all the abutting property. The wells and sewers were located on <br /> five abutting properties. He said that the. proposed new leaching is <br /> more than satisfying to Mrs. Anderson, <br /> Ir. Spohr pointed out a mote on the drawing which states that -there i <br /> a 50 foot long existing 4"' PVC basement drain 47 Feet plus or minus <br /> from the channel. He said that Mrs. Anderson suggested that they either <br /> plug or remove that line. <br /> Mr. Spohr said that the former owner, Whited & Condon, did not intent to <br /> drain sewage directly into the channel. He said that it is a drain with <br /> perforated pipe which goes around the exterior wall of the basement and <br /> it is not within 25 feet of the proposed leaching. The new owner, Mr. <br /> Portnoy agrees to either remove the drain or plug it. <br /> Mr. Spohr told the Commission that Gary Tavares will remove the material <br /> of the sewer. He will remove all the existing, unsuitable material within � <br /> a radius of 10 feet all around the flow diffusor and replace it with a <br /> clean coarse sand and gravel, He said that the first time that the draw- <br /> ings were submitted to Mrs. Anderson they came back because they had <br /> neglected to show the detail of the switch valve. lie said that the Town <br /> of mashpee is the only Town he knows of that has that requirement in their <br /> by-law. <br /> Pauline Deory asked what the depth of the pipe is: Mr. Spohr explained i <br /> that a portion of the pipe is at the surface and another portion was at <br /> the basement depth of 8 feet.
