s <br /> Mashpee Conservation Commission <br /> i liut es of April 25 , 1984 page <br /> Continuance of Harr Fel er Hearin <br /> The hearing of Harry Felger was continued on the request to construct <br /> a pier on mot IS Tide Run, Little Neck Bay. Peggy Collins of BSC - <br /> Cape Cod Survey Consultants was present during the continuance. Re- <br /> vised pians were reviewed by the Board. his. Collins explained that <br /> the original plan was for the pier to be built at right angles and <br /> the float on end intercepted with abutting pier. The new design of <br /> the pier has been dog-legged to prevent the crisscross* <br /> Pauline De ory asked ghat the length of the pier would be as it was <br /> not marked on they-revised plan. ms. Collins said that she would get <br /> } <br /> back to the Commission with the measurements. She said that the mater- <br /> 0ac would be Wolmani ed. <br /> Ms. Collins mentioned that the Cohen pier proposal has infringed on <br /> the rights of her client by using a straight right-angle projection <br /> into the pond. She said that they had discussed this with DEQE Water- <br /> ways' John zajak and his department has not issued any permit or li- <br /> censing yet as he feels that there may be a problem :with reference to <br /> the Cohen pier. She said that they have not filed with Waterways for <br /> the Felger pier as of yet. <br /> Ms. Collins said that perhaps the Cohen representatives, along with <br /> the Commission and her could get together to discuss possible realign- <br /> rent so that both piers could be positioned off shore of the properties <br /> n a manner that would be more appropriate, She commented that once a <br /> structure does in, it effects all of there down the way. She said that <br /> at this point in time, the option for either the original pian presented <br /> r the redesigned plan would be acceptable depending what the State sloes. <br /> Chairpersoin Studley commented that she would. have to apply to the Board <br /> of- Appeals i it is over 45 feet from mean low water. <br /> No further questions were asked by the Commission, <br /> Discussion Maushop Access Rout <br /> Chairperson Studley commented that there were cement blocks on the bank <br /> Peggy Collins said that nothing is going over the bank and that what was <br /> seem is old fill that has been in the bank and coastal erosion is expos- <br /> .ng all of ghat is there. <br /> Chairperson Studley said that it had been observed that front--end loaders <br /> were taking it down bucket after bucket on Monday. She said that it was <br /> junk and parts of buildings. She said that the bluff is going to go and <br /> that it was pathetic to work so hard to sage it and noir have it look like <br /> that. <br /> Peggy -Collins said that she took exception to the Commission saying that <br /> debris and other unclean fill is being put down on the coastal bank be- <br /> cause to her knowledge and to her inquiries of what has been going on, it <br /> has not been the case. She said old stuff has been exposed, <br /> Vis. Collins addressed the roadway by saying that it was brought to her <br /> attention that the Commission had sent the Police to cease and desist the <br /> removal of a small section of the old pavement which was on the northerly <br /> access. She said that there was some old pavement between the front row <br /> of cottages and the second row of cot t ' e s. She said that they were in <br /> the process of removing it and taking it array from the bank and not using <br />
