Chairperson <br /> Studley asked about the clamshell road. She commented that it was <br /> not in the original plan, 1s. Collins said that the clamshell is <br /> the "permanent access" route (non-paved) which will be used for the <br /> beach nourishment. She said that it was the Commission's request <br /> that they close off the one at the south and move as,-=far back as they <br /> could with any approach and protect Rock Landing interest to the beach <br /> along the north. She said that the clamshell represents that access <br /> which will be used in the beach nourishment program. she said that <br /> they were trying to regrade under beach nourishment and under all the <br /> other orders which they have had at Maushop and reseed that area that <br /> has characteristically been giving them problems along the RockLand- <br /> ing boundary because the run-off had run right down by the edge of the <br /> bank and gulleyed along that boundary with Rock Landing. She said that <br /> the approach and the nature of using the shell was to increase the pe co- <br /> ,. a ion_rd.t r_:than the Moff and help all vi ate the on-going erosion <br /> problems. She said that she talked with Sam mygatt and Dare Shepardson <br /> from MEPA about it and satisfied any of their c uesti' ns and concerns, <br /> They had asked her to specifically contact l named Mrs. Henning, <br /> who is an abutter, and inform her a t what is going on and to get back <br /> to them after discussing the matter with her. <br /> Chairperson Studley asked Ms. Collins if she was saying that the clam-- <br /> shell road was in the original plans s. Collins said that she was <br /> saying that it serves as the access. Chairperson Studley asked if she' <br /> was telling the Board that it was in the original plans Ms. Collins <br /> replied 'gas an access" and not specifically at that location. Chair- <br /> person Studley commented that it was done without a proper order of <br /> conditions. Ms. Collins said that if the Commission read the order of <br /> conditions issued that the roadway and the advice that the Commission <br /> had given and requested of them every time they have come before them <br /> fails withdn permutable limits both in the order of conditions issued in <br /> relation to beach nourishment and in specific requests that the Commis- <br /> sion had rade repeatedly about getting everything back further and fur- <br /> ther from the bank. She said that was the intention. <br /> Ms. Collins asked what the procedure was that they should follow as <br /> New Seabury would lake to continue to remove the chunked out black top <br /> rh i h is there and hydro-seed the area. She said that the fact that <br /> there is a cease and desist, it will promote run-off and erosion down <br /> the bank and along the edge. <br /> Chairperson Studley said that the Commission will discuss it further. <br /> Hear.ina of Eugene Rubin - continued <br /> They following hearing of Eugene Rubin to construe an addition onto <br /> an existing home located at 251 Popponesset Island. Road was presented <br /> by William Warwick. Mr. Warwick apologized for missing the last meet- <br /> ing. He explained that there will be a 6 foot addition 20 feet 4 inches <br /> long on the front of the house, He said that there would be no disturb- <br /> ance on the ground as the addition will be above. The foundation is al- <br /> ready there. Mr. Warwick said that they would be intruding on the con- <br /> servation zone 6 feet more in the air, He said that the wall, dock and <br /> pier were all existing. No further questions were asked. <br />
