DeMichelle sa-id that they wanted <br /> view of the pond and the Building Inspector said that ; would be okay to <br /> to pe the trees wn she sal{ that h never mentioned the onservati <br /> Commission to them. tvir, Demichelle told the Commission that her engineer, <br /> r. , Costs., t Ad them that a long their were back 1ee he w ul not <br /> have to go through the process. He said that the house is 175 Feet back. <br /> x <br /> A4avne Tavares asked the erviich lie' s what they hoped to gain by clearing the <br /> land? Firs, OeNichelle said that they wc- ted access to the pond and the view, <br /> hairper; on Studley said teat she did anon-site inspection. She said that <br /> F. the lot is approximately 91 feet wide where the house is and possibly a little <br /> bit wider alone the pond. she said that the complete front has been leveled. <br /> She said that on the far side, there is a very high bank where the trees were <br /> cut,o she said that the Commission is not objecting to the cutting of the <br /> trees but to the re-grading of the entire area, she said that here is a <br /> fresh water wetland in that area and the pictures show that the machine. went <br /> to the water. <br /> Wane Tavares asked if mr. Laute was the operator of the machine, He re- <br /> plied "Yes". Wayne commented that everyone is so aware of conservation in <br /> this day and age. He asked if he was aware? r: LaBute said that they told <br /> him that they had permission to cut the trees, He asked if the cease and <br /> desist is in effect now: chairperson Studley replied "yes, between the house <br /> and the water". bane asked where the septic system was? Chairperson Studley <br /> said that the construction was outside the 100 foot mark and that work was <br /> permitted to go ahead. Wayne asked if the Building Inspector advised them t <br /> see the Conservation Commission, firs. Demichelle said that they hired All <br /> State survey ro Costa and he said that everything that he planned out for <br /> therm. was all within legal range. Chairperson Studley said that the Commission <br /> is not telling there that they cannot build their douse or grade the area, but <br /> that it has to be done with the proper order of conditions. <br /> Mr. DeMichelle said that they would have liked to build closer to the water, <br /> but they did not know that they could have come to get permission. <br /> The pictures were reviewed closely. wayne asked if it was a steep bank <br /> Iry DeMichelle said that there is 1 , 000 s . Ards. of fill in there. Pauline <br /> commented that the pictures do not depict the depth of the lot. <br />
