She said that on the far side, there is a very high bank where the trees were cut,o she said that the Commission is not objecting to the cutting of the trees but to the re-grading of the entire area, she said that here is a fresh water wetland in that area and the pictures show that the machine. went to the water. Wane Tavares asked if mr. Laute was the operator of the machine, He re- plied "Yes". Wayne commented that everyone is so aware of conservation in this day and age. He asked if he was aware? r: LaBute said that they told him that they had permission to cut the trees, He asked if the cease and desist is in effect now: chairperson Studley replied "yes, between the house and the water". bane asked where the septic system was? Chairperson Studley said that the construction was outside the 100 foot mark and that work was permitted to go ahead. Wayne asked if the Building Inspector advised them t see the Conservation Commission, firs. Demichelle said that they hired All State survey ro Costa and he said that everything that he planned out for therm. was all within legal range. Chairperson Studley said that the Commission is not telling there that they cannot build their douse or grade the area, but that it has to be done with the proper order of conditions. Mr. DeMichelle said that they would have liked to build closer to the water, but they did not know that they could have come to get permission.
