Mashpee Conservation Commission <br /> minutes of May 9. 1984 Page <br /> Discussion on Maushop..._Violation <br /> Chairperson Studley asked for ratification of the Cease and Desist order <br /> ration for the beach nourish- <br /> mentshe had issued to the New eabury corporation nouns <br /> meat project and for the Cease and Desist order issued to the Maushop <br /> Cottage owners for the cottage relocation proposal. Jean Thomas moved to <br /> ratify the Cease and Desist orders issued by Chairperson tud ey. Pauline <br /> Deorr second the motion. All members present were in favor. None op- <br /> posed. Note: Charles Buckingham was not present during ratification of <br /> the orders ) * <br /> Peggy Collins of BSC, Cape Cod Survey Consultants, appeared before the <br /> Commission later in the evening representing the New 15eabury Corporation <br /> with reference to the Cease and Desist order issued for the beach nourish- . - <br /> rent project, she requested an on-site -inspection with a majority of the <br /> Commission to take them out to the site, walk over the site and to go over <br /> the Cease and Desist order to get a clear understanding of what the viola- <br /> tion is. Collins saiei that she knew what was written on the Cease and <br /> Desist order and that she had some problems with what was written referenc- <br /> ing <br /> efe en - <br /> .no it to the Order of Conditions and reconciling that to what is out there. <br /> 's. Collins brought a plan of the area to the meeting in which she pointed <br /> out cottage -1 and the approximate bound between Rock Landing and Maushop <br /> Village. she said that under the beach nourishment program and under the <br /> cottage relocation and regrading program, they showed on the plana filed <br /> the access route to be in the area indicated in "red". She said that they <br /> were referenced in the order of Conditions under beach nourishment which <br /> said to use the existing access way for the beach projects. ms. Collins <br /> referenced the Order of Conditions for the Ylaushop Village area which she <br /> said stated: 'via area previously used for reconstruction and rebuilding <br /> of bank areas". 's. Collins said that it was the northerly access and <br /> mown by one of the cottages was the southerly access. The Commission, she <br /> said, asked her verbally to close off that access as the bank was steeper <br /> there and that they did not want -the machinery getting close to the edge <br /> of that access point. Ms. Collins said that they closed it and the Com- <br /> mission received a copy of a letter stating that they were to use it no <br /> longer. She said that it left the only access in the area indicated in <br /> �r <br /> red" . <br /> Niss Collins said that the Commission has asked thea or the l'ew eabury <br /> Corporation constantly everytime she has been out in the field with them or <br /> at a meeting to stay as far back from the top of the bank as possible beyond <br /> the 50 foot level. he said what happened was the opportunity to create the <br /> clamshell driveway back 149 feet from the top of the bank and to use that as <br /> the semi-permanent access route to the beach for the nourishment programs <br /> and for the bank stabilization programs. when the drive was put in, the <br /> area which was disturbed and had tar and various other things in it was in <br /> the process of having the tar taken out' and being regraded and hydro-seeded <br /> so that no activity would take place in this area, Ms. Collins said that <br /> that point was 28 Feet from the top of the coastal bank and the existing <br /> area was 57 feet from the top of the coastal, bank which was within the magic <br /> o foot area that the Commission had requested no activity to take place, <br /> she said that route is the same route which has been there for years. <br /> At thisp oint in the meeting, � .
