I tried to get <br /> an idea of, number one; had they complied with that order and to what <br /> degree has the project, been completed. ' She discussed with me a lot of <br /> the things she intended to be done that construction people did without <br /> her knowing. My suggestion to her was to put in writing a request for a <br /> certificate of compliance on that part of the project that has been com- <br /> pleted and let's just get the 31project over with and done and worry <br /> about our order of conditions on 395. <br /> She seat a letter to the letter to the conservation commission on Eebeary 6. <br /> tA,h 1*c h 1 _thought was very inadequate as it did not describe exactly what they <br /> had done on this project, so, she followed it up with .a letter of March <br /> identifying better~ and, I think, more satisfactorily, as to what was done <br /> exactly on 316 and is a current order of business for the commission to <br /> address in terms of whether or not to issue a certificate of compliance <br /> for that project. <br /> March duPont: We did receive it, we've been holding it waiting for,you. <br /> Stan Humphries : So , I guess the bottom line i s , as far -as I see i t, if <br /> the commission sees it fit to agree that the case pending for the clan shell <br /> Road is not a proper one to pursue any further in court I believe the cert- <br /> ificate <br /> ert- <br /> ifica e of compliance can be issued on the work that was partially done <br /> under 316 and that with additional comments from the commission to Barry <br /> Fogel of D.E. .E. a final order~ of conditions can be drawn .up by the state <br /> and there actually will be and, in fact, a l rger responsibility will be <br /> placed at the state level for compliance. This is going to be their final <br /> order. Now,, there certainly i s every reason to believe that the commission <br /> still has the authority where you are in town , Brett Burdick and Dt E. .E. <br /> are up in Lakeville and not going to see what is happening on a daily basis. <br /> I think the commission certainly has , still has , the authority to issue en- <br /> forcement orders if they so desire. If they don' t and would like to work <br /> with D.E.O. . on a more consistent basis that is all right too. I guess <br /> that is where I stand on the matter right now. I would personally like t <br /> see the case dropped and move on with one order of condition that would apply <br /> to this regional beach nourishment program. Maybe additional fads that you <br /> don't know about or may seem obvious , their access route number two, Popponesset <br /> Inn , has been dropped. of course there is development there so there is. no way <br /> for access so that all sand can be brought in access one and there will be only <br /> point of access east of Rock Landing. The other facts we would like to present <br /> is that I spent about an hour* and one-half walking down the extent of the pro- <br /> ject and back up to the sandy beach and then back again. I took a long listing <br /> of the hype of debris that I observed on the beach which I think .you are all <br /> familiar with so I won't go through it. I think it is very important to have <br /> in the conditions that they clean the beach before they renourish it. In the <br /> long term I think we can all see that they are just placing sand on the beach <br /> to try o address a long term erosion problem. <br />
