Y
A
Conservation Commission
Executive Session
April 3 , 1986
Page 4.
Stan Hu ph i s_speaking - continued :
ued
The proposal for the wall i s still being worked on. So, i t is something to
deep in mind for the future that the project is going. to come back. As far
as I could tell , the portions of the beach that have rip- rap or some structures
protecting land above are not doing that bad of a ,fob for that land that por-
tion of the wall i s in front. However, on adjacent sides of those walls the
bank is increasing. Al-so, in front on the seaward side of these l o' ati ons
where there are walls , there is virtually no beach, no sandy beach , there is
all rock. The process that has taken place there is a reflection of weight
energy downward and sands moving offshore. A very easy observation to make
the day I went out there on the beach there was a lot of sand there and there
was cross country ski marks on the beach. I never thought of that as a rec-
reational use of the beach but the point here is they can only come so far
in this direction and had to stop because there isn ' t any beach, only rocks.
It is an important recreational facility to maintain out there and the sooner
the orders of conditions are granted then they can provide the sand for the
beach which I think is better for everybody. Do you have any questions that
I right answer?
Pauline DeLory: On the sand nourishment, d you consider that a mai me-nam
to be done every year?
Stan Humphries: Well , it's actually going to have to be done for the amount
that they are talking about. Realistically , I think they are going to have
to do it twice a ,year as they proposed. The one part of the project I really
felt uncomfortable about was them having the freedom for thea to come in and
do it with an impending storm. I mean , what's an impending storm? Is it a
tropical depres i n that starts up way down in the "a ri bbean
Pauline Del ory; The Order of Condi ti ons only lasts three ears .
Stan Humphries : That' s true, that' s a very good point in terms of perhaps
letting them give it a try and see how it goes and have at the end of that
time some substantial reason to suggest that the project not go forward.
Eliot Rosenberg : It is ray understanding that D.E.Q. F. was going to issue
this. for a much longer period than three years . I was t the hearing with
Y
Barry Fogel , I .have never seen what came out of it, but I was at that- beariong
and he indicated very clearly that they were going to give the order, or iie
was thinking of the order for the longest l egal l v pons i bl e period.
Stan Humphries ; Well , that is where I pul l out the rags with Brett Burdick
and that is clearly in the regulations . I think there is some l eewa.y that
the department has in extending a period for longer, but this is ghat w
came out of that meeting with.
Eliot Rosenberg :b r : I have another question , why can't the 1i nal order be
worked out so that whatever has to be done with 316 and whatever~ is going
to be dome with 395 be done at the sane time and then it becomes , by neg-
otiation or however, it become an order of this commission rather than
D*E. . E. and then we have direct enforcement rights. I thunk that this
