Mr. lei renberg stated they have never~ tried to Circumvent the authority <br /> of the commission and the project t i s not completed as work was stopped in October. <br /> He stated ars error was made in roving the pool to the side. Returns were re- <br /> ceived for 7 of the 10 abutters. <br /> Mr. Clark advised he discussed the wall with a Mr. Dererais and the walli l l <br /> have four tie backs into the cement structure of the pool to hold the retaining <br /> wall . His office has suggested to Control erosion., a 4 X 4 stone. catch. He <br /> advised that from the original purr the house is shifted forward and the pool <br /> moved to the side, which i s further from the cogs dal bank, An encroachment i <br /> shown over the easernent. <br /> Mrs. Ferriday asked what provisions have been made for emptying the pool <br /> Mr. Nirenberg stated , if necessary, a hose would empty into a gutter in the <br /> street or driveway or to be pumped and trucked away. <br /> Ms. Bebrman stated permission from New Seabury is required on the encroachment <br /> on the reserved area prior to an order of Conditions, Mr. Nirenberg stated <br /> they are prepared to work this out with New Seabury by putting steps on the <br /> New Seabury right of way, for which he had permission. He wi 11 trade the <br /> steps and their up-keep for the two feet of land. <br /> Mr. Nirenberg requested permissicn to take steps to stop water from entering <br /> the hou 3e from erosion around the pool . When asked if he had an occupancy <br /> permit, Mr. Nirenberg stated he did not knov. . A letter was dictated to the <br /> Building Inspector to notify hire of the occupancy. Mr. Rosenberg stated there <br /> are no provisions to change the grade and therefore water problems will continue. <br /> Mr. Ni renberg was advised the house does not conform to the plans . He was <br /> told to provide detailed plans of what is proposed. He was further instructed <br /> to stake and maintain hay bales as ordered. <br /> CONTINUED UNTIL LETTER IS RECEIVED FROM NEW SEABURY AND NEW FLAKS PROVIDED. <br />
