Hay ba1es will be provided. <br /> TAKEN UNDER ADVISEMENT <br /> '•nnia w r'■ <br /> Ernest Virgilio was scheduled for hearings on the three town landings , -but d i d <br /> not appear, <br /> The Commission discussed. getting advisors -on -board ow., Elliot Rosenberg advised <br /> the Commission has the right to appoint a Director.,, Clerk, Consultants and- other <br /> employees and may - contra C t for materials and services from available funds, but <br /> that does not include those people who could be voting members of the commission, <br /> It was suggested the Mashpee Messenger write an article stating interested em- <br /> bers were being sought for the Commission. <br /> CONSERVATION OFFICER: <br /> Question has been- raised regarding the dredging o <br /> opponesset Bay an whether the orders of Conditions can b modified a they <br /> are going from 12,000 cubic yards to an estimated 22,000. yards or do they have <br /> to re-apply. After discussion, it was agreed they should contact DE for <br /> guidance whether to resubmit and the Commission would comply with their wishes . <br /> Concerning calls from Jack Motes , SE 43-561 , it was agreed to send him a copy <br /> Of a letter previously dictated and the order of Condi ions issued, A copy <br /> Of sane to go to Stephen VanTol . <br /> John Malloy requested ars extension for _an Order of Conditions issued three <br /> years ago. The septic and -well are the only completed items . - John to send <br /> a letter stating Order of Conditions expire after two years and he must re- <br /> ppl . <br /> Charles Nirenberg - It was noted no response Inas been received from New Sebur <br /> with regard to the encroachment. After discussion it was agreed to send a letter <br /> to New Seabury Corp. stating a hazardous situation a is-ts on the easement bordering <br /> the 114 i renberg property consisting of a railroad -ti-le, retaining wall i n., danger of <br /> collapse and request that they take immediate action and inform the Commission <br /> of the action to be taker. A letter was also dictated -to Mr. -Ni renberg stating <br /> if a progress report is not received within two weeks , action will be taken on <br /> the continued hearing, with a cosy to Choate, Hall & S-L,ewart. <br /> There was discussion of the 21 day time constraint. Elliot Rosenberg adv i sed <br /> many towns have a town bylaw as well as DEE which allows them to give ars answer <br /> on the state statute but are not bound to give an answer on the town by-law and <br /> both are necessary for the applicant to proceed. <br /> Ms Behrman advised she spoke with Sally Newbury at the Conservation Law Found- <br /> ation this week regarding the article. She stated she had problems with this <br /> also and agreed to review it but this would not be prior to the August Town <br /> eeti ng. After discussion i t was agreed to postpone this . <br />
