Dardano declared that a quorum was present at this meeting as Elliot Rosenberg has not, as yet, been sworn in by the Town Clerk. Therefore , the Board, at present, consists of six voting members , Barn Stone -(All Cape survey Consultants , Inc . - Agent This application, for which an order of Conditions was written and issued on August 15, 1985 denying without pre judice the proposed project, was re--considered. Chris Costa, agent for the applicant, presented Clarification of the legality of the dock, such clarifica- tion having been deemed necessary by the Board. Orders of Conditions were written and issued allowing said project with the following special conditions : . No mechanical equipment shall be allowed in the pr o j e c t area. 2. No vegetation is to be disturbed, No alterations to the coastal bank will be permitted, . An elevation of 51 above the bank must be maintained From the ramp to the dock. Reference is made to an Emergency Order of May 2 , 1985 with which tcr~e was no Compliance , A certification of emergency conditions was written and will be issued immediately to Christopher Eurden, President of New Sea.b ry Corporation and Jane Petersen, Public Relations Director of New S e abury corporation.
