Conservation Commission <br /> Meeting of February 5, 1987 <br /> Page 8. <br /> Mr. Harrington agreed to the requests . John will send a letter stating the <br /> requests of the Commission. <br /> CONTINUED INDEFINITELY. <br /> o - Joseph Foley (Doyle Engineering) To construct and maintain a dwelling <br /> with attached garage and deck, sewage system and well at lots 517- 0 Point <br /> Road. Steve Doyle presenting . Mr. & Mrs . Foley were present also. Copies <br /> of abutters receipts were presented . The closest point to the resource area <br /> ill be the deck which is 36 feet , 49 feet to the edge of the structure. Hay <br /> bales are proposed along the 8 foot contour line as a work l im i t, The lot i <br /> staked . <br /> John stated an on-site was done two weeks ago for the originalhearing and his <br /> major concern was the delineation of the ACEC. The elevation of this property <br /> and the one going in next to it is radically different. In talking to Mr. Foley <br /> and his surveyor , there had been an error and the new plans submitted are corr- <br /> ected. The AE is defined as the 5 foot contour. (The ACEC is just about the <br /> edge of the wetland) Because it is within an A E , he recommended the Board <br /> take particular care. He stated the project, if allowed , should have ha bale <br /> in a horseshoe configuration . <br /> Ms Behrman stated a variance woluld be required from the Board of Appeals for the <br /> o foot setback which should be received before coming before the commission un- <br /> less they could rove it back 14 feet . <br /> Mr . Boyle p ronfe r red to move it' back and agreed to revise the plan. He asked 1 f <br /> there .-)ere any other concerns . <br /> It vias agreed the hay bales should be 6-10 feet from the house turned the other <br /> way to contain siltation. To the question of clearing to be done, Mr . Doyle <br /> stated very little as the lot is open. <br /> An abutter , Robert R. DeLorey, Map 114-44 and 114-36 stated he has visited the <br /> lot a number of times and has seen no stakes . He i s concerned wi th the boundary <br /> lines. <br /> . <br /> Mr. Doy l e s to ted i t was s to ed and a 1 so the owner of record -of the ma rsh i s 1 i s ted <br /> as unknown at Town Hall , per the Assessors . <br /> Ms. Behrman stated when the plan is revised , Mr . DeLorey should check the corner <br /> stakes a t that time. <br /> Mr. DeLorey advised this is one large piece of property with one smaller piece <br /> they are severing off. The zoning is 40,000 square feet. They are making one <br /> property 13 ,950 and Mr. Foley, who is not the owner of record as yet , has 12,762.5.- <br /> He spore with the Town Planner who stated this could not be done because of the <br /> zoning . <br /> Mr . Behrman stated this 'told also recurre a zoning variance. Mr. Doyle stated <br /> this was discussed with the Building Department and is not necessary . <br /> MS <br /> Behrman stated documentation of this ,-4ould be necessary. <br /> } <br />
