He suggested a common <br /> dock between the two. He advised he had made an appeal to the Board of Appeals <br /> on this ratter which is pending. He asked if future issues with reset to the <br /> dock should be addressed to the Waterways and ACOEO <br /> ..d.. <br /> Ms Behran advised after the order of conditions has been issued there is a ten <br /> working day appeal period during which he can appeal -the decision to., D.E. .E. <br /> as far as conservation principles are concerned. on navigational the <br /> g g <br /> State -Waterways aterways would be involved if the ACOS permits have not been obtained,, <br /> I <br /> She suggested the matter be addressed to them. <br /> There was discussion o a continuance being required i ap r erappeal has been <br /> filed with the Board Appeals. _ . <br /> P <br /> I . 'Finn stated he has a stamped copy of the receipt o the appeal da <br /> to that Board., <br /> Mr. Zeger -tat d it- has to be appealed to the Superior court in order to have <br /> any validity, When appealed to the Board of Appeals, it runs through the 21 <br /> day period, It has lapsed as it was not appealed to Superior court. <br /> Mrs. Marsters stated if the appeal causes any change they would have to come <br /> back for a new order of conditions but that the commission could condition it <br /> now. <br /> Mr'. Rosenberg stated the appeal does not have any validity as concerns the <br /> Commission unless revoked, The Commission is bound by the original decision, <br /> Ms Beh man stated upon receipt of the plans for the ramp, the hearingwill be <br /> closed and an Dade o Cord itior issued within 21 days <br /> . <br />
