L t <br /> Mashpee Conservation Commission <br /> Meeting of July 16, 1987 <br /> Page 2. <br /> Joel Zeger - Arrow Engineering-Agent, Continued: Mr. Raymond stated when Mr, <br /> Finn put in his dock, Mr* Zeger gave his approval and Mr. Finn stated he would <br /> reciprocate in Id nd whan r. 7. e r applied, <br /> Ms Behrman requested copies of the letters referred to and Mr. Raymond complied. <br /> 1,11, <br /> Mr. Raymond advised the construction will be the same as for other docks in the <br /> area. . <br /> John stated an on-site was completed. The marsh is well developed and there is <br /> plenty of water and there should be no major impact on the bottom. He stated <br /> the concern is with the congestion of docks in the area which does not come <br /> under Commission control. He questioned the gravel walkway and asked if the <br /> ramp and walkway could be roved back 5 feet to the top of the slope, C rushed <br /> stone is proposed to go over- the edge of the slope down into the marsh. <br /> Mr, Raymond agreed to etnd the walkway structure. <br /> Mr. Rosenberg questioned the retaining walls as pant of the proposal . It was <br /> noted they are under a different order of conditions. <br /> In answer to Ms Behrman's question re elevation, Mr. Raymond stated 3-1/2 and i <br /> she stated this should be noted on the plans. <br /> The Chairman opened the floor to comments. <br /> Bill Irwin, Lot 275, Stated that according to ACOS regulations, a float of that <br /> magnitude isnot allowed. <br /> -Ms Behr--Man stated this would come under- the State Waterways and ACOS purview, <br /> She ;suggested the newspapers be watched for notice of this and concerns should <br /> be addressed to them. <br /> Paul Picarilio advised Mr. Person's approval had been sought and granted but <br /> he is not the owner of lot 267. Inference was rade that the dock was moved <br /> over to lot 267 with the authorization and acgu.iescence of Mr. Pearson who <br /> does not own Lot 267. <br /> . Mr. Raymond stated they go by the assessor's records. <br /> It was noted Mr, Pearson approved this on June 1 , 1987 and did not own the lot <br /> as f May 14,, 1987. Mr. Picarillo stated his concern is that he will he applying <br /> for a dock soon and will be unable to have one. <br /> Mr, Finn stated lir. Raymond in his presentation made reference to the fact that <br /> he seat a letter. That letter was sent prior to the disclosure of14 . eger' s <br /> plan, When Mr. Zeger signed his Uotter,, the ,-plan was in front of him to see <br /> where -the -dock ,could be, He advised it was stated in his letter,, "thank you <br /> for approving the proposal for ray dock. - You may be. assured I will reciprocate <br /> your courtesy when you make application for yours." It did not state he would <br /> give unqualified approval . The Array Corps of Engineers requires that you sign <br /> -a statement after ,you see the position of the dock on the drawings that ,you <br /> have no objection to the position of the dock. Mr. Fina stated he was not <br /> ,given that opportunity nor has he given permission and would submit to the <br /> .ward a letter to the Corp-s of E lgineers specifically protesting this. He <br /> .does .not wish to deny Mr, Zeger a dock, but there is not enough room left in <br />
