Orlow stated whether a License or an easement , if this has <br /> been runnins that way for a very long time and no one has said or done <br /> anything about i t, is that not essentially the ingredient necessary. <br /> FIs Behrman stated this is not the proper forum to venture an an- <br /> swer . She thanked for Orl ow for coming. <br /> Mrs . Jacobson advised of severe erosion on the beach at Johns <br /> Pond Park. John stated he notified all parties concerned that in the <br /> Determination of Applicability permission was Siven for a berm and <br /> drywell . This has not been done and it is suggested this be accomp- <br /> lished immediately. <br /> Andrea Lahauser of BSC, representinS Ban Hostetter and Cape <br /> Harbor Realty, came before the commission for a brief overview pre- <br /> sentation . She advised last night was the first meeting with the <br /> Planning Board for the definitive subdivision, "water' s a" , on <br /> Sa to i t Pond. She stated because it is an opera space cluster subdiv- <br /> ision <br /> uf diision in the towns of Barnstable and Mashpee, she felt the Planning <br /> Board would like the Commission' s environmental input. The Commission <br /> was invited to visit the site consisting of 55. 8 acres total , 55. 1 in <br /> the town of l ashpee. There is 2 , 450 feet of frontage along Santu i t <br /> Pond on the southeast side across the street from Loells Pond . There8, <br /> two cranberry bogs amounting to 15. 8 aures which are not part of the <br /> subdivision although they are owners in common between them. There is <br /> one acre of shrub swamps. The connection between the open ditch, pond <br /> and cranberry boS is a concrete pipe runninS beneath. An Order of <br /> Conditions from the Barnstable Conservation Commission has been rec- <br /> eived to put a bridge culvert across the ditch which is a replacement <br /> of a cranberry bog ditch which is unable to hold the traffic. <br /> All roadways and secondary access are along existing bog roads or <br /> existing travelled ways. The secondary access goes along the side o <br /> the bog down into the subdivision and is strictly for emergency and <br /> fire use and is an exIsting 10 foot dirt way. There is no reason to <br /> improve i t other than putting in hardening and levelling. 1 t will not <br /> be open to the general public. All roadways and buildings are as far <br /> out of the Commission' s jurisdiction as possible. The closest build- <br /> ing to the cranberry bog Is 155 ft. , to the pond front is 168 ft. The <br /> closest buildina to wetland is 105 ft. There may be some intrusion <br /> into the 100 ft. buffer on the back side, the limit of work of a <br /> building and potentially, a beach frontage alonS the Santuit River be- <br /> tween two swamp areas. There is an existing travelled way down there <br /> and they may request a beach area with only removal of vegetation and <br /> no docks. <br />
