Abutters receipts were presented . <br /> Ms Behrman advised a side l the variance is on the Board of Health <br /> agenda this week. <br /> Mr. Slavins y stated this was gained under a previous plan. Under the <br /> previous situation the lot was to be sold. They went before the Board <br /> of health Monday asking the variance for the„ sideli a for the leaching <br /> facility. It is less than 10 feet and was granted before under the <br /> previous plan. The question is whether it went with the lot or the <br /> applicant.. The 'Board of health stated if the Commission will go along <br /> with the basic idea of the project,. .they would lice him to notify all <br /> the abutters to the lot again requesting the variance to the side <br /> line The house is s close to the .street as possible. There is a <br /> trench tywe leaching faci-lity. T <br /> Ms Behrman read into the record a letter from the Board of Health <br /> stating a sideline variance from 10 to 5 feet was granted (already <br /> granted by DEQE on another plan , same lot) . Grant variance from 100 <br /> feet to. 57 feet from leaching to wetland pending Conservation <br /> approval . Mr. Sl air i n ky stated he did not request the 57 foot variance <br /> and is not sure they should be requesting it, <br /> Mr. Burns suggested moving everything forward. Mr. Slavinsy stated <br /> that would require Board of Appeal action and this corp forms t -Zoning <br /> y laws r <br /> Ms Behrman stated, looking at the -closeness to she wetland as well a <br /> an ACEC and given the 'additional impact of the fill a variance should <br /> e requested* <br /> Mrs . Fer i day asked what would 'keep the fill there and was. told it <br /> will be vegetated. Mr . Slavinsky stated it is a 2 to l slope . Ms <br /> Behrman - pointed out the plan goes from 14 feet to 22 feet in an 1 <br /> foot distance. r. Sl air i nsy stated th.e natural grade is 18 feet , 1 <br /> at the' work limit and the house has to cone up 4 feet. Ms Behrman <br /> stated there will be an extremely steers slope and hay dales won ' t keep <br /> the fill in place* <br /> Mr . Slavins y asked if the o mi cion would be willinZ to put some <br /> correspondence in to the Board of Appeals. and the Commission agreed. <br /> Ms Berman stated the attestation of onersh i p i s written as Sweeney ', <br /> R. E. R. E. Sr . There seems to be an alteration to Gordon Correia, <br /> neither of which is the applicant . Mr. Slavinskystated this was <br /> changed in Anne Shaw' s office . Ms Behrman requested he have Anne <br /> initial tine change <br /> Lisa stated the other plans stated -the well next door was going to b <br /> capped, now it is not. She asked -ire reason, as on the other plan the <br /> leaching facility is in a much better spot . Mr. Slayinsky advised Mr. <br /> a igian , or his partner , do not own Lot 38. There may have been some <br /> agreement with that owner to move it. <br />
